HomeMy Public PortalAboutR0183 R E S O L U T I O N NO. 183 WHEREAS, the Board has received a petition from property owners in the area of Waymire Avenue and North Elm Avenue in St. Louis County, Missouri, for the construction of sanitary lateral sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such sanitary lateral sewers will be approximately One Hundred Forty-five Thousand Dollars ($145,000.00), and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 57 (North Webster Lateral) of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing sanitary lateral sewers in the area of Waymire Avenue and North Elm Avenue in St. Louis County, Missouri, said subdistrict to be described as follows: Beginning at a point, said point being the easternmost corner of Lot 26 of Block 2 of Brentwood Subdivision as recorded in Plat Book 3 on Page 3 of the St. Louis County Records; thence southwestwardly along the southeast line of said Lot 26 and said line produced southwestwardly to its intersection with the northeast line of a lot now or formerly owned by Oliver and Mary Poole as recorded in Deed Book 560 on Page 522 of the St. Louis County Records; thence southeastwardly along the northeast line of said Poole property to the easternmost corner of said Poole property; thence southwestwardly along the southeast line of said Poole property to its intersection with the centerline of Willis Avenue, 50' wide; thence southwestwardly in a straight line across Willis Avenue to the northeast corner of Lot 25 of Rose Bud Park Subdivision as recorded in Plat Book 15 on Page 20 of the St. Louis County Records; thence southwestwardly along the east line of Lots 25 through 49 of said Rose Bud Park Subdivision and along the east line of Lots 1 and 2 of Allen's Subdivision as recorded in Plat Book 8, Page 144 of the St. Louis County Records to the southeast corner of said Lot 2; thence westwardly along the south line of said Lot 2 and said line produced to its intersection with the east line of Lot 40 of Block 4 of Brentwood Subdivision as recorded in Plat Book 3 on Page 3 of the St. Louis County Records; thence southwardly along said east line of said Lot 40 to the southeast corner of said Lot 40; thence westwardly along the south line of said Lot 40 to the southwest corner of said Lot 40; thence northwardly along the west line of Lots 40 and 41 of said Block 4 to the northwest corner of said Lot 41; thence westwardly along the south line of Lot 21 of said Block 4 and said line projected westwardly to the east line of Lot 42 of Block 3 of said Brentwood Subdivision; thence northwardly along the east line of said Lot 42 to the northeast corner of said Lot 42; thence westwardly along the north line of said Lot 42 to the northwest corner of said Lot 42; thence southwardly along the east line of Lot 21 of said Block 3 to the southeast corner of said Lot 21; thence westwardly along the south line of said Lot 21 and said line projected westwardly to the east line of Lot 5 of Block 5 of Mentor Place Subdivision as recorded in Plat Book 3 on Page 24 of the St. Louis County Records; thence southwardly along said east line to the south east corner of said Lot 5; thence westwardly along the south line of said Lot 5 to its intersection with the west line of a lot now or formerly owned by Walter and Henrietta Madison as recorded in Deed Book 2540, Page 71 of the St. Louis County Records; thence northwardly along said west line and said line projected northwardly to its intersection with the south line of a lot now or formerly owned by DeWitt T. and Ethel Marie Douglas as recorded in Deed Book 2665 on Page 564 of the St. Louis County Records; thence westwardly along the south line of said Douglas property to its intersection with the east line of Lot 4 of said Mentor Place Subdivision; thence northwardly along said east line to its intersection with a line parallel to and 150' north of the north line of Lithia Avenue, 40' wide; thence westwardly along said parallel line to its intersection with the west line of Lot 3 of said Mentor Place Subdivision; thence northwardly along said west line of said Lot 3 and said line projected northwardly to its intersection with the north line of Thornton Avenue, 40' wide; thence westwardly along said north line of Thornton Avenue to its intersection with the east line of Lot 10, Block 3 of said Mentor Place Subdivision; thence northwardly along said east line and said line projected northwardly to its intersection with the south line of Lot 29 of Block 3 of Nast's Subdivision as recorded in Plat Book 9, Page 59 of the St. Louis County Records; thence eastwardly along the south line of said Lot 29 and Lot 30 of said Block 3 to the southeast corner of said Lot 30; thence northwardly along the east line of said Lot 30 to the northeast corner of said Lot 30; thence northwardly in a straight line across Almentor Avenue to the southeast corner of a lot now or formerly owned by Robert and Lena Allen as recorded in Deed Book 1355 on Page 572 of the St. Louis County Records; thence northwardly along the east line of said Allen property to the northeast corner of said Allen property; thence eastwardly along the eastward prolongation of the north line of said Allen property to its intersection with the west line of Lot 16 of Block 1 of said Nast's Subdivision; thence southwardly along said west line of said Lot 16 to the southwest corner of said Lot 16; thence eastwardly along the south line of Lot 16, 17 and 18 to the southeast corner of said Lot 18; thence northwardly along the east line of said Lot 18 and said line produced northwardly to its intersection with the western prolongation of the south line of Allison Avenue, 30 feet wide; thence eastwardly along said prolongation to its intersection with the southern prolongation of the west line of Lot 30 of Block 1 of said Brentwood Subdivision; thence northwardly along said prolongation and along said lot line to the northwest corner of said Lot 30; thence eastwardly along the north line of Lots 30 through 21 of said Block 1 across Cornell Avenue, 40 feet wide and along the north line of Lots 18 through 26 of Block 2 of said Brentwood Subdivision, the point of beginning. Such sewers to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all land which shall be found to be benefitted by the said construction in the proportion that the area each such parcel of land bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area; and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 57 at such time and place as the Executive Director shall determine, for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed special benefit subdistrict. The foregoing Resolution was adopted June 9, 1958.
