HomeMy Public PortalAboutR0185 R E S O L U T I O N NO. 185 WHEREAS, the Board has received a petition from property owners in the area of Lithia Avenue in St. Louis County, Mo., for the construction of a sanitary lateral sewer to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such a sanitary lateral sewer will be approximately Six Thousand Dollars ($6,000.00), and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 59 (Lithia Avenue) of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing a sanitary lateral sewer in the area of Lithia Avenue in St. Louis County, Mo., said subdistrict to be described as follows: Beginning at a point, said point being the southwest corner of a lot now or formerly owned by Walter and Henrietta Madison as recorded in Deed Book 2540 on Page 71 of the St. Louis County Records; thence northwardly along the west line of said Madison property and said line produced northwardly to its intersection with the south line of a lot now or formerly owned by Dewitt T. and Ethel Marie Douglas as recorded in Deed Book 2665 on Page 564 of the St. Louis County Records; thence westwardly along said south line to its intersection with the east line of Lot 4 of Block 5 of Mentor Place Subdivision as recorded in Plat Book 3 on Page 24 of the St. Louis County Records; thence northwardly along the east line of said Lot 4 to its intersection with a line parallel to and 150' north of the north line of Lithia Avenue, 40' wide; thence westwardly along said parallel line to its intersection with the west line of Lot 2 of said Block 5; thence southwardly along said west line and said line produced southwardly to the centerline of Lithia Avenue; thence eastwardly along said centerline to its intersection with the centerline of Plateau Avenue; thence southwardly along said centerline of Plateau Avenue to its intersection with the westward prolongation of the south line of Lots 1 through 16 of Block 9 of Webster Heights Subdivision as recorded in Plat Book 24 on Page 60 of the St. Louis County Records; thence eastwardly along said prolongation and along said south line of Lots 1 through 16 to the southeast corner of said Lot 16; thence northwardly along the east line of said Lot 16 to the northeast corner of Lot 16; thence northwardly in a straight line across Lithia Avenue to the point of beginning. Such sewer to be connected with a certain existing public sewer of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED, that special benefit 3 assessments be levied against all land which shall be found to be benefitted by the said construction in the proportion that the area each such parcel of land bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area; and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 59 at such time and place as the Executive Director shall determine for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed special benefit subdistrict. 4 The foregoing Resolution was adopted June 9, 1958.
