WHEREAS, the Board received a petition from property
owners in the area of Kingwood Street in St. Louis County,
Missouri, for the construction of sanitary lateral sewers to serve
such area; and
WHEREAS, investigation showed the necessity for such
improvement because said area is not now served by sewers; and
WHEREAS, by Resolution No. 160 the Board created
Special Benefit Subdistrict No. 43 for the purpose of constructing
sanitary lateral sewers within the boundaries of the area of such
special benefit subdistrict; and
WHEREAS, by Resolution No. 165 the Board found and
declared that it is in the public interest to proceed with such
improvement; and
WHEREAS, because part of the area included in such
special benefit subdistrict has been sewered privately, it is
necessary to abolish the said special benefit subdistrict and to
proceed with a new one of smaller area; and
WHEREAS, the Board finds and declares the necessity of
the improvement of the remaining smaller area by the construction
of sanitary lateral sewers therein; and
WHEREAS, it has been estimated that the probable cost
of the installation of such sanitary lateral sewers will be
approximately Nineteen Thousand Dollars ($19,000.00), and that the
most practicable method of payment therefor is by special tax
bills or other evidence of special benefit assessments upon the
land which shall be found to be benefitted by such improvement,
whether public or private;
NOW, THEREFORE, BE IT RESOLVED that Resolutions Nos.
160 and 165 be and the same are hereby repealed.
BE IT FURTHER RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 61 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing sanitary lateral
sewers in the area of Kingwood Street in St. Louis County,
Missouri, said subdistrict to be described as follows:
Beginning at a point, said point being the intersection of
the west line of Joel Street and the north line of Heege
Road; thence westwardly along said north line of Heege Road
to the southwest corner of Lot No. 13 of Block No. 54 of
Lakewood First Addition Subdivision as recorded in Plat Book
6, on Page 59 of the St. Louis County Records; thence
northwardly along the west line of said Lot No. 13 and said
line projected to the southeast corner of Lot No. 6 of said
Block No. 54; thence westwardly along the south line of said
Lot No. 6 to the southwest corner of said Lot No. 6; thence
westwardly in a straight line across Kingwood Street to the
southeast corner of Lot No. 19 of Block No. 65 of said
subdivision; thence westwardly along the south line of said
Lot 19 and Lot 6 of said Block 65 to the southwest corner of
said Lot 6; thence southwestwardly across Labelle Street to
the southeast corner of Lot 18 of Block 66 of said
subdivision; thence westwardly along the south line of said

Lot 18 to the southwest corner of said Lot 18; thence
northwardly along the west line of said Lot 18 through 24 of
said Block 66 to its intersection with the south line of
Faber Avenue; thence eastwardly along the south line of Faber
Avenue to its intersection with the west line of Joel Street;
thence southwardly along the west line of Joel Street to the
point of beginning.
Such sewers to be connected with a certain existing
public sewer of The Metropolitan St. Louis Sewer District.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all land which shall be found to be
benefitted by the said construction whether public or private, in
the proportion that the area each such parcel of land bears to the
entire benefitted area exclusive of public streets, roads and
alleys within the said benefitted area.
BE IT FURTHER RESOLVED, that a public hearing be held
within said Special Benefit Subdistrict No. 61 at such time and
place as the Executive Director shall determine, for the purpose
of determining whether or not it is in the public interest that
such improvement, or any part thereof, be made, and that notice of
such hearing be given by the posting of notices in not less than
three public places within the boundaries of the proposed special
benefit subdistrict.
