HomeMy Public PortalAboutR0190 R E S O L U T I O N NO. 190 WHEREAS, the Board has received a petition from property owners in the area of Reavis Road and Tesson Ferry Road in St. Louis County, Missouri, for the construction of storm sewers to serve such area; and WHEREAS, investigation has shown the necessity for such improvement by reason of the fact that said area is not now served by sewers; and WHEREAS, it has been estimated that the probable cost of the installation of such storm sewers will be approximately One Hundred Seventy-five Thousand Dollars ($175,000.00), and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land which shall be found to be benefitted by such improvement; NOW, THEREFORE, BE IT RESOLVED, that a special benefit subdistrict to be known as Special Benefit Subdistrict No. 62 of The Metropolitan St. Louis Sewer District be and the same is hereby created for the purpose of constructing storm sewers in the area of Reavis Road and Tesson Ferry Road in St. Louis County, Missouri; that the construction of storm sewers in said area is necessary in order to protect the health of the residents therein; that such sewers shall be storm sewers capable of serving the watershed; that the estimated cost of constructing such storm sewers will be approximately One Hundred Seventy-five Thousand Dollars ($175,000.00); that such costs shall be paid for by special tax bills or other evidence of special benefit assessments upon the benefitted land in the area; and that such storm sewers be constructed in the area described as follows: Beginning at a point, said point being the northwest corner of Lot 12 of Block of A of Wolff Homesites #2 Subdivision as recorded in Plat Book 33 on Page 21 of the St. Louis County Records; thence southwardly along the west line of said Lot 12 to the southwest corner of said Lot 12; thence southeastwardly in a straight line across Lanor Drive, 50' wide, to a point in the north line of Lot 7 of Block B of said subdivision, said point being 100' east of the northeast corner of said Lot 7; thence southwestwardly in a straight line to the southwest corner of said Lot 7; thence southwardly along the west line of Lots 6, 5 and 4 of said Block B to the southwest corner of said Lot 4; thence eastwardly along the south line of said Lot 4 to its intersection with the building line 50' west of west line of Antonia Drive 50' wide; thence southwardly along said building line to its intersection with a line parallel to and 60' south of the south line of said Lot 4; thence eastwardly along said parallel line to its intersection with the west line of Lot 5, Block A; thence south along said west line to southwest corner of Lot 5; thence east along south line of Lot 5 to 50' building line; thence south along building line across Lots 4 and 3 to a line 75' northwest of and parallel to the centerline of Lakeside Drive, 50' wide, formerly known as Christian Drive; thence southeast parallel to and 75' northeast from said centerline to the west line of said 3 Tesson Ferry Road; thence northerly along said west line to a point on the westerly prolongation of the north line of Arv- Ellen Court Road, said north line also being the south line of property now or formerly owned by H. and B. Crowell, recorded in Book 2632 on Page 458 of St. Louis County Deed Records; thence easterly across Tesson Ferry Road and along the south line of said Crowell property to a point 130.65' west of the southeast corner of said Crowell property; thence north parallel to the east line of said Crowell property and the east line of property owned by E. and B. Strehle as recorded in Book 2460, Page 549, to a point on the north line of said Strehle property, said point being 77.35' east of the east right of way line of Tesson Ferry Road, 60' wide; thence east along said line, also being the south line of property owned by Elizabeth Muckler, as recorded in Book 2173 on Page 357 of said County Records, 130.65', more or less, to northeast corner of said Strehle property, thence continue east along south line of said Muckler property 34.35'; thence northeast across said Muckler property to a 6' diameter three-forked tree, said tree being 198' south at right angle to the north line of said Muckler property, and 28' east of the southwest corner of E. Cook property on Reavis Road, as recorded in Book 2217, Page 555, of the County records; thence S 88Ε 13' E 342.09; thence S 60Ε 46' E 247.19' plus or minus to a point on east line of said Muckler property being 322.0' southerly from the northeast corner of said 4 property; thence S 65Ε 56' E 310.17', more or less, to a point 40.0' west and 440.0' southerly from the southeast corner of J. and T. Shulz property on Reavis Road having 112.90' frontage thereon and adjacent to the W. J. Prahl property on said road as recorded in Book 2057 on Page 448 of the County Deed Records; thence N 63Ε 39' E across J. and T. Shulz property and the St. Louis San Francisco Railway right of way, 100' wide, a distance of 484.56', more or less, to a line parallel to and 25' west of the centerline of said 100' right of way; thence N 1Ε 37' E parallel to said centerline 131.89'; thence N 51Ε 42' W 463.57' more or less, to the east line of said J. and T. Shulz property along Reavis Road having a frontage thereon of 112.90'; thence northerly along said east property line 90', more or less, to a line 40' south of, and parallel to, the southerly right of way line of Reavis Road, 40' wide, thence westerly along said 40' line 312.91', more or less, to the east line of R. Such sewers to be discharged into a tributary of Gravois Creek. BE IT FURTHER RESOLVED, that special benefit assessments be levied against all land which shall be found to be benefitted by the said construction whether public or private, in the proportion that the area each such lot or parcel of land bears to the entire benefitted area exclusive of public streets, roads and alleys within the said benefitted area; and BE IT FURTHER RESOLVED, that a public hearing be held within said Special Benefit Subdistrict No. 62 at such time and place as the Executive Director shall determine, for the purpose of determining whether or not it is in the public interest that such improvement, or any part thereof, be made, and that notice of such hearing be given by the posting of notices in not less than three public places within the boundaries of the proposed special benefit subdistrict. 11 The foregoing Resolution was adopted July 7, 1958.
