WHEREAS, the Board has received a petition from
property owners in the area of San Fernando Hills in the City of
Florissant in St. Louis County, Missouri, for the construction of
a storm sewer to serve such area; and
WHEREAS, investigation has shown the necessity for such
improvement by reason of the fact that said area is not now served
by a storm sewer; and
WHEREAS, it has been estimated that the probable cost
of the installation of such storm sewer will be approximately One
Hundred Fifty-five Thousand Dollars ($155,000.00), and that the
most practicable method of payment therefor is by special tax
bills or other evidence of special benefit assessments upon the
land which shall be found to be benefitted by such improvement;
and
WHEREAS, by Resolution No. 176, adopted by the Board
May 9, 1958, Special Benefit Subdistrict No. 52 of The
Metropolitan St. Louis Sewer District was created for the purpose
of constructing a storm sewer in the area of San Fernando Hills in
the City of Florissant, and a public hearing was held in
accordance with Resolution No. 176; and
WHEREAS, the Board desires that another public hearing
be held in order to give all persons interested an opportunity to
be heard;
NOW, THEREFORE, BE IT RESOLVED that Resolution No. 176
be and the same hereby is repealed.
BE IT FURTHER RESOLVED, that a special benefit
subdistrict to be known as Special Benefit Subdistrict No. 52 of
The Metropolitan St. Louis Sewer District be and the same is
hereby created for the purpose of constructing a storm sewer in
the area of San Fernando Hills in the City of Florissant in St.
Louis County, Missouri; that the construction of a storm sewer in
said area is necessary in order to protect the health of the
residents therein; that such sewer shall be a storm sewer capable
of serving the watershed; that the estimated cost of constructing
such storm sewer will be approximately One Hundred Fifty-five
Thousand Dollars ($155,000.00); that such costs shall be paid for
by special tax bills or other evidence of special benefit
assessments upon the benefitted land in the area; and that such
storm sewer be constructed in the area described as follows:

Beginning at a point, said point being the northeast
corner of Lot 49 of West Duchesne Hills as recorded in Plat Book
63, Page 12 of the St. Louis County Records; thence southwardly
along the east line of said West Duchesne Hills to a point, said
point being the northwest corner of Lot 5 of Block 6 of Locust
Spring Subdivision as recorded in Plat Book 68, Page 29 of the St.
Louis County Records; thence southeastwardly in a straight line

northwardly along a line parallel to and 80' east of the east line
of St. Patrick Lane to its intersection with the northwest line of
Lot 49 of said West Duchesne Hills Subdivision; thence
northeastwardly and eastwardly along the northwest and north line
of said Lot 49 to the point of beginning.
Such sewers to be discharged into Fountain Creek, a
tributary to Coldwater Creek.
BE IT FURTHER RESOLVED, that special benefit
assessments be levied against all land which shall be found to be
benefitted by the said construction in the proportion that the
area each such parcel of land bears to the entire benefitted area
exclusive of public streets, roads and alleys within the said
benefitted area; and
BE IT FURTHER RESOLVED, that a public hearing be held

within said Special Benefit Subdistrict No. 52 at such time and
place as the Executive Director shall determine for the purpose of
determining whether or not it is in the public interest that such
improvement, or any part thereof, be made, and that notice of such
hearing be given by the posting of notices in not less than three
public places within the boundaries of the proposed special
benefit subdistrict.
