WHEREAS, a public sewer now in operation lies about
thirty-five feet underground in a sewer easement in a strip of
ground sixty feet wide in City Block 3485 E-W of the City of St.
Louis, said strip having been known as Bircher Avenue until
vacation of it as a street on April 20, 1904 by Ordinance 21,512
of the City of St. Louis, and
WHEREAS, the lessee of the land in which such sewer
lies and the building construction contractor of the lessee have
requested permission to construct a light-weight building over a
concrete slab located partly in said easement strip and over said
sewer, and examination of the plans and specifications of such
proposed building shows that it would neither damage the sewer nor
interfere with use of the easement strip, and
WHEREAS, the lease involved provides that such building
will be removed by the lessee upon termination of the lease, which
by its terms will expire in 1980,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strip until
termination of the said lease by expiration or otherwise, subject
to earlier revocation whenever reasonably appears that the public
interest would be served by such revocation, provided that the
right of the District to use the easement strip is preserved, and
under suitable indemnity provisions.
The foregoing Resolution was adopted August 4, 1958.
