WHEREAS, there exists within The Metropolitan St. Louis
Sewer District and within the County of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenance,
and which it is desirable for the District to operate and
maintain, and,
WHEREAS, the owners of Glen Abbey, a subdivision of St.
Louis County, Missouri, according to the plat thereof recorded as
Daily No. 131, February 23, 1955, in the St. Louis County Records,
by such record plat dedicated the easements as shown thereon to
the City of Frontenac for sewer purposes; and by instrument dated
March 31, 1955, and recorded in Book 3397, Page 217 of the St.
Louis County Records dedicated the sewers in such easements to the
District, subject to the District's assumption, by resolution, of
responsibility for maintenance and operation; and by instrument
dated the 25th day of July, 1958, the trustees of such subdivision
have granted the District an easement over the subdivision streets
for sewer purposes, and
WHEREAS, there is doubt and dispute as to title to some
of the sewers in and adjacent to such subdivision, which sewers
were not included in the foregoing instruments, and there is
general disclaimer of title by the interested parties; and
WHEREAS, the District by Ordinance No. 88, adopted the
16th day of July, 1956, is authorized to assume title to any or
all sewers, easements and appurtenances by resolution whenever, in
the opinion of counsel, no person competent to convey title can be
found, and upon recommendation of the Executive Director that the
District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers, and the Executive Director
recommends that the District should assume title to such sewers,
NOW, THEREFORE, BE IT RESOLVED, that title to the
following described sewers and their appurtenances in the County
of St. Louis be and are hereby assumed by The Metropolitan St.
Louis Sewer District for public use, operation and maintenance:
All those sanitary and storm water sewers and
appurtenances located in the easements and drives of
Glen Abbey, a subdivision of St. Louis County,
Missouri, according to the plat thereof recorded as
Daily No. 131, February 23, 1955, in the St. Louis
County Records, and sewers in Spoede Road adjacent to
such subdivision, and a sewer crossing the Missouri
Pacific Railroad right-of-way at a point near the
common boundary line of Lots 21 and 22 of such
subdivision. The foregoing ResoLution was adopted September 2, 1958.
