WHEREAS, a public sewer now in operation lies in a
sewer easement in a strip of ground fifteen feet wide in City
Block 5048 of the City of St. Louis, said strip having been an
alley until vacation of it as an alley on December 28, 1948 by
Ordinance 44,792 of the City of St. Louis, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building over a concrete
slab located in said easement strip and over said sewer, and
examination of the plans and specifications of such proposed
building shows that it would not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strip, subject to
revocation whenever it reasonably appears that the public interest
would be served by such revocation, provided that the right of the
District to use the easement strip is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted September 2, 1958.
