HomeMy Public PortalAboutR0215 R E S O L U T I O N NO. 215 WHEREAS, the Board has received a petition from property owners in St. Louis County for the construction of sanitary sewers to serve such area, and WHEREAS, investigation has shown that such area is not adequately served by such sewers and that the public health is affected, and WHEREAS, it is estimated that the probable cost of installation of such sewers will be approximately One Hundred Twenty Thousand Dollars ($120,000.00) and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land benefited by such installation. NOW, THEREFORE, BE IT RESOLVED that the construction of adequate lateral sanitary sewers in the area described below is necessary in the interest of the public health; that such sewers shall consist of approximately 7,800 lineal feet of 8 inch vitrified clay pipe, which shall be capable of efficiently serving or draining the entire local drainage area; that the estimated probable cost of such improvement is One Hundred Twenty Thousand Dollars ($120,000.00); that the entire cost of such improvement shall be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement; and that such improvement be constructed in St. Louis County in the area described as follows: 2 East Anastasia Subdistrict Beginning at a point, said point being the northwest corner of Lot 25 of Block 1 Burke City Subdivision as recorded in Plat Book 21 on Pages 8 and 9 of the St. Louis County Records; thence eastwardly along the north line of said Block 1 to the northeast corner of Lot 15 of said Block 1; thence southwardly along the east line of said Lot 15 to the southeast corner of said Lot 15; thence southwardly in a straight line across Barto Drive, 40 feet wide, to the northeast corner of Lot 43 of Block 6 of said subdivision; thence southwardly along the east line of said Lot 43 and along the east line of Lot 24 of said Block 6 to the southeast corner of said Lot 24; thence eastwardly along the south line of Lots 23 through 16 of said Block 6 to the southeast corner of said Lot 16; thence northwardly along the east line of said Lot 16 to the northeast corner of said Lot 16; thence eastwardly along the north line of Lots 15 through 8 of said Block 6 to the northeast corner of said Lot 8; thence northwardly along the west line of Lots and 3 of said Block 6 to the northwest corner of said Lot 3; thence eastwardly along the north line of said Lot 3 and said line projected eastwardly to the centerline of New Florissant Road; thence southwardly along said center line to its intersection with the eastward projection of the south line of Lot 7 of Block 34 of said Burke City Subdivision; thence westwardly along said projection and along said south line of said Lot 7 to the southwest corner of said Lot 7; thence northwardly along the east 3 line of Lot 8 of said Block 34 to the northeast corner of said Lot 8; thence southwestwardly along the southeast line of Lots 63 through 57 of said Block 34 to the southernmost corner of said Lot 57; thence north- westwardly along the southwest line of said Lot 57 to the westernmost corner of said Lot 57; thence westwardly in a straight line across Young Drive, 40 feet wide, to the southernmost corner of Lot 17 of Block 31 of said Burke City Subdivision; thence northwestwardly along the southwest line of said Lot 17 to the westernmost corner of said Lot 17; thence southwestwardly along the southeast line of Lots 62 through 54 of said Block 31 to the southernmost corner of said Lot 54; thence northwestwardly along the southwest line of said Lot 54 to the westernmost corner of said Lot 54; thence northwestwardly in a straight line across Anastasia Drive to the southernmost corner of Lot 58 of Block 23 of said subdivision; thence northwestwardly along the southwest line of said Lot 58 to the westernmost corner of said Lot 58; thence northeastwardly along the northwest line of Lots 58 through 98 of said Block 23 and said line projected northeastwardly to its intersection with the northeast line of Flora Avenue; thence northwestwardly along said northeast line to the westernmost corner of Lot 15 of Block 12 of said subdivision; thence northeastwardly along the northwest line of Lots 15 through 7 to the southeast corner of Lot 36 of said Block 12; thence westwardly along the south line of Lots 36 through 22 of said Block 12 to the southwest corner of said Lot 22; thence northwardly along the west line of said Lot 22 and said line produced northwardly the northwest corner of Lot 34 of Block 7 of said Subdivision; thence eastwardly along the north line of Lots 34 through 28 of said Block 7 to the northeast corner of said Lot 28; thence northwardly along the west line Lot 42 of said Block 7 to the northwest corner of said Lot 42; thence northwardly in a straight line across Connolly Drive to the southwest corner of Lot 26 of Block 6 of said subdivision; thence northwardly along the west line of said Lot 26 to the northwest corner of said Lot 26; thence westwardly along the south lines of Lots 40 through 34 of said Block 6 to the southwest corner of said Lot 34; thence 5 northwardly along the east line of Boehner Drive to the point of beginning, 6 such facilities to flow into or be connected with existing lateral sanitary sewers located at two points, each situated approximately 100 feet outside the aforementioned area, which area shall be the area benefited by such improvement and which is hereby designated as Special Benefit Subdistrict No. 66 (East Anastasia) of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED that special benefit assessments for the entire cost of such improvement be levied against all land in the above described Special Benefit Subdistrict No. 66, whether public or private, in the proportion that each such lot or parcel of land bears to the entire benefited area of such Special Benefit Subdistrict No. 66, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED that a public hearing be held within said Special Benefit Subdistrict to afford all persons interested in said improvement an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution; and that notice of such hearing shall be given by the posting of notices in not less than three public places within the boundaries of said Special Benefit Subdistrict. The foregoing Resolution was adopted on November 13, 1958.
