BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT that the Executive Director
be, and he hereby is, authorized to execute the MODIFICATION OF
AGREEMENT, in the form hereto appended, between the District and
Hazelwood Coldwater Trunk Line, Inc.
BE IT FURTHER RESOLVED that on and after the 1st day of
January, 1959, the District shall undertake the maintenance and
operation of the sanitary trunk line sewer system and temporary
septic tank, heretofore operated and maintained by said Hazelwood
Coldwater Trunk Line, Inc., in keeping with the said MODIFICATION
OF AGREEMENT and subject to full performance thereof.
MODIFICATION OF AGREEMENT
THE METROPOLITAN ST. LOUIS SEWER DISTRICT ("District")
and HAZELWOOD COLDWATER TRUNK LINE, INC. ("Contractor"), being
parties to an original agreement made the 30th day of July, 1955,
do hereby agree to modify such original agreement as hereinafter
stated.
1. The District assumes the exclusive duty to operate
the trunk line sanitary sewer system and septic tank referred to
in said original agreement, effective the 1st day of January, 1959
and thereafter, subject to adoption in the year 1958 of an
appropriate resolution as provided in paragraph numbered 11 of
said original agreement.
2. The Contractor's right to levy assessments under
paragraph numbered 11 of said original agreement shall cease with
respect to any costs which may be incurred by Contractor on and
after the 1st day of January, 1959.
3. The Contractor will convey and dedicate to the
District on the 1st day of July, 1959 complete title to said
sanitary sewer system, septic tank, rights-of-way therefor, and
appurtenant contractual rights. Upon acceptance of such title by
the District, the Contractor's rights and privileges under said
original agreement, all and several, shall cease and determine.
IN WITNESS THEREOF, the Parties have caused these
presents to be duly signed and sealed this _________ day of
December, 1958.
