HomeMy Public PortalAboutR0221 R E S O L U T I O N NO. 221 WHEREAS, the Board received a petition from property owners in St. Louis County for the construction of sanitary sewers to serve such area, and WHEREAS, investigation showed that such area is not adequately served by such sewers and that the public health is affected, and WHEREAS, the Board created a special benefit subdistrict by Resolution No. 212, adopted November 13, 1958, in response to such petition, and WHEREAS, the public hearing directed by such Resolution was not called and held, and WHEREAS, it is now estimated that the probable cost of installation of such sewers will be approximately Forty-five Thousand Dollars ($45,000.00), which includes some Five Thousand Three Hundred Twenty-eight Dollars ($5,328.00) in fees required for connection of such sewers to a privately owned sewer system in Capitol Hill Plat No. 4 Subdivision which in turn drains into the privately owned Blackjack Creek Trunk Sewer, and WHEREAS, the most practicable method of payment of the cost of installation of such sewers is by special tax bills, or other evidence of special benefit assessments upon the land benefited by such installation, NOW, THEREFORE, BE IT RESOLVED that Resolution No. 212, adopted November 13, 1958 be, and the same is, hereby repealed. BE IT FURTHER RESOLVED that the construction of 2 adequate lateral sanitary sewers in the area described below is necessary in the interest of the public health; that such sewers shall consist of approximately 3,100 lineal feet of 8" vitrified clay pipe, which shall be capable of efficiently serving or draining the entire local drainage area; that the estimated probable cost of such improvement is Forty-five Thousand Dollars ($45,000.00), including the aforesaid connection fees in the sum of Five Thousand Three Hundred Twenty-eight Dollars ($5,328.00); that the entire cost of such improvement shall be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement; and that such improvement be constructed in St. Louis County in the area described as follows: (SEE NEXT PAGE) 3 GREEN SLOPE DRIVE Beginning at a point, said point being the northeastern corner of Lot 1 of Capitol Hill Plat No. 4 subdivision as recorded in Plat Book 58 on Page 9 of the St. Louis County Records; thence westwardly along the North line of said subdivision to the northwest corner of Lot 13 of said subdivision; thence southeastwardly along the southwest line of said Lot 13 and said line projected southeastwardly to its intersection with the South line of Old Manor Drive; thence eastwardly along said South line to the northwest corner of Lot 36 of said subdivision; thence southwardly along the West line of said Lot 36 to the southwest corner of said lot 36; thence eastwardly along the South line of Lot 36 and 37 of said subdivision to the southeast corner of said Lot 37; thence southwardly along the West line of Lot 29 of said subdivision and said line projected southwardly to its intersection with the South line of Green Slope Drive; thence eastwardly along said South line to the West line of Lot 25 of said subdivision; thence southwardly along said West line to the southwest corner of said Lot 25; thence eastwardly along the South line of Lots 25, 26, 52, 53, 54, 55, 56, 57 and 58 of said subdivision to the southeast corner of said Lot 58; thence northwardly along the East line of said Lot 58 and said line projected northwardly to its intersection with the centerline of said Green Slope Drive; thence westwardly in a straight line to 4 the southeast corner of Lot 49 of said subdivision; thence northwestwardly along the easternmost line of said Lot 49 to the South line of Lot 43 of said subdivision; thence eastwardly along said line to the southeast corner of said Lot 43; thence northwardly along the East line of said Lot 43 to the South line of Old Manor Drive; thence eastwardly along the South line of Old Manor Drive to its intersection with the West line of Halls Ferry Road; thence northwardly along said West line to the point of beginning, 5 such facilities to flow into or be connected with existing lateral sanitary sewers located at two points, Point "A" being at the southwest corner of Halls Ferry Road and Green Slope Drive, Point "B" being at the southwest corner of Lot 44 of Capitol Hills Plat No. 4 Subdivision, said points of connection being located about 200 feet outside of the said area, which area shall be the area benefited by such improvement and which is hereby designated as Special Benefit Subdistrict No. 65 (Green Slope Drive) of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED that special benefit assessments for the entire cost of such improvement be levied against all land in the above described Special Benefit Subdistrict No. 65, whether public or private, in the proportion that each such lot or parcel of land bears to the entire benefited area of such Special Benefit Subdistrict No. 65, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED that a public hearing be he]d within said Special Benefit Subdistrict to afford all persons interested in said improvement an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution; and that notice 6 of such hearing shall be given by the posting of notices in not less than three public places within the boundaries of said Special Benefit Subdistrict. The foregoing Resolution was adopted December 17, 1958.
