HomeMy Public PortalAboutR0223 R E S O L U T I O N NO. 223 WHEREAS, the Board has received a petition from property owners in St. Louis County for the construction of storm sewers to serve such area, and, WHEREAS, investigation has shown that such area is not adequately served by such sewers and that the public health is affected, and WHEREAS, it is estimated that the probable cost of installation of such sewers will be approximately Twenty-five Thousand Dollars ($25,000.00) and that the most practicable method of payment thereof or is by special tax bills, or other evidence of special benefit assessments upon the land benefited by such installation, NOW, THEREFORE, BE IT RESOLVED that the construction of adequate storm water drains and storm sewers in the area described below is necessary in the interest of the public health; that such sewers shall consist of approximately 1020 feet of pipe varying from 12 to 30 inches in diameter, which shall be capable of efficiently serving or draining the entire local drainage area; that the estimated probable cost of such improvement is Twenty- five Thousand Dollars ($25,000.00); that the entire cost of such improvement shall be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement; and that such improvement be constructed in St. Louis County in the area described as follows: (SEE NEXT PAGE) 2 HEIM DRIVE SUBDISTRICT Beginning at the northeast corner of Lot 71 of Weber- Dana Gardens Subdivision as recorded in Plat Book 62 on Page 11 of St. Louis County Records; thence southwardly along the eastern line of said Lot 71 a distance of 60 feet to a point; thence westwardly in a straight line across said Lot 71 to a point in its western line, said point being a distance of 50 feet from the southwestern corner of said Lot 71; thence southwestwardly in a straight line across Lot 72 of said subdivision to a point in the northeastern line of Lot 73 of said subdivision, said point being a distance of 40 feet from the northeastern corner of said Lot 73; thence southwestwardly in a straight line across said Lot 73 to a point in the northern line of Lot 74 of said subdivision, said point being a distance of 40 feet from the northeastern corner of said Lot 74; thence southwardly in a straight line across said Lot 74 to a point in the southern line of said Lot 74, said point being a distance of 50 feet from the southeastern corner of said Lot 74; thence eastwardly along the southern line of said Lot 74 a distance of 14 feet to a point; thence southwardly across Lots 75, 76, 77 and 78 of said subdivision along a line parallel to and 36 feet west of the western line of Kenstan Court, 50 feet wide, to a point, 54 feet south of the northern line of said Lot 78; thence continuing in a straight line southeastwardly across said Lot 78 to the intersection of the western line of Kenstan Court, 50 feet 3 wide, and the northern line of Francis Court, 50 feet wide; thence southwardly in a straight line across Francis Court, 50 feet wide, to the northwestern corner of Lot 8 of Block 2 of Forman Place View Subdivision as recorded in Plat Book 36 on Page 4, St. Louis County Records; thence southwardly along the west line of said Lot 8 to its intersection with a line parallel to and 45 feet south of the southern line of said Francis Court, 50 feet wide; thence eastwardly across Lots 8 and 7 of said Block 2 along said parallel line to the western line of Lot 6 of said Block 2; thence southwardly along said western line and along the western line of Lot 25 of said Block 2 to a point, said point being a distance of 43 feet from the northwestern corner of said Lot 25; thence eastwardly in a straight line across said Lot 25, to a point in the western line of Lot 2 of said Block 2, said point being 16 feet southwardly from the northern line of said Lot 2; thence eastwardly along a line parallel to and 16 feet south of the northern line of said Lot 2 a distance of 70 feet; thence northwardly along a line parallel to and 70 feet east of the western line of said Lot 2 a distance of 30 feet to its intersection with a line parallel to the north line of said Lot 2; thence northeastwardly across said Lot 7 along a straight line to the northeastern corner of said Lot 4 7, said corner also being in the western line of Lot 6 of said subdivision; thence northwardly along said western line of Lot 6 to a point 65 feet from the northwestern corner of said Lot 6; thence eastwardly along a straight line across said Lot 6 to a point in the eastern line of said Lot 6, said point being a distance of 25 feet from the northeastern corner of said Lot 6; thence southwardly along the eastern line of said Lot 6 a distance of 15 feet to a point; thence eastwardly across Lot 5 of said subdivision along a line parallel to the southern line of said Lot 5 a distance of 50 feet to a point; thence continuing northeastwardly in a straight line across said Lot 5 to the northeastern corner of said Lot 5; thence eastwardly along the northern line of Lot 12 of Forman Place Subdivision as recorded in Deed Book 828 on Page 528 of St. Louis County Records a distance of 100 feet to a point; thence southeastwardly in a straight line across said Lot 12 to its intersection with the westward projection of a line midway between the northern and southern lines of Lot 322 of Indian Hills No. 5 Subdivision as recorded in Plat Book 83 on Page 16 of the St. Louis County Records, at a point 35 feet west of the western line of said Lot 322; thence northeastwardly in a straight line to the northwest corner of said Lot 322; thence northwardly along the western line of Lots 321, 320, 319, 318, 317 and 316 of said subdivision to the northwestern corner of said lot 316; thence westwardly along the southern line of Lots 289 and 288 of said subdivision to the southwestern corner 5 of said Lot 288; thence northwardly along the western line of Lot 288, 287 and 286 of said subdivision to a point being 30 feet northwardly from the northeast corner of a tract described in deed to Marvin and M. Hammon, recorded in Book 3643, Page 413, St. Louis County Records; thence westwardly along a line parallel to the northern line of said Hammond tract to the eastern line of a tract described in deed to Roy A. and Roy M. Elam, recorded in Book 2408, Page 158, St. Louis County Records; thence northwestwardly in a straight line to a point within the Elam tract, said point being 20 feet from its northern boundary measured along a line parallel with its eastern boundary and 56 feet from its eastern boundary measured along a line parallel with its northern boundary; thence westwardly along a line parallel to the northern boundary of said Elam tract to its western boundary; thence northwardly along the western boundary of said tract to its northwestern corner, said corner being in the southern line of Tulane Park Subdivision as recorded in Plat Book 34 on Page 25, St. Louis County Records; thence westwardly along said southern line to a point in the southern line of Lot 13 of said subdivision, said point being 20 feet from the southwestern corner of said Lot 13; thence northwardly across said Lot 13 along a line parallel to its western line to a point five feet southwardly from the northern line of said Lot 13; thence westwardly along a line parallel with said northern line to the western line of said Lot 13; thence northwardly along the western line of Lots 13, 12, 11 6 and 10 of said Tulane Park Subdivision to its intersection with the eastward projection of a line midway between the northern and southern lines of Lot 57 of said Weber-Dana Gardens Subdivision; thence westwardly along said projected line to a point 58 feet from the western line of said Lot 57; thence southwardly along a line parallel to the eastern line of Lots 57 and 58 of said subdivision to a point in the southern line of said Lot 58; thence westwardly along the southern line of Lots 58 and 48 of said subdivision to a point, said point being 30 feet from the southwestern corner of said Lot 48; thence northwardly along a line parallel with the eastern line of said Lot 48 a distance of 20 feet to a point; thence westwardly along a line parallel to the southern line of said Lot 48 to a point in the northeastern line of Lot 47 of said subdivision; thence southwardly along a line parallel to the eastern line of said Lot 47 a distance of 35 feet to a point; thence eastwardly along a line parallel to the southern line of said Lot 47 to the eastern line of said Lot 47; thence southwardly along the eastern line of said Lot 47 to the northeast corner of Lot 71 of said subdivision, the point of beginning; 7 such facilities to flow into or be connected with existing storm sewers located approximately 10 feet outside the aforementioned area, which area shall be the area benefited by such improvement and which is hereby designated as Special Benefit Subdistrict No. 68 (Heim Drive) of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED that special benefit assessments for the entire cost of such improvement be levied against all land in the above described Special Benefit Subdistrict No, 68, whether public or private, in the proportion that each such lot or parcel of land bears to the entire benefited area of such Special Benefit Subdistrict No. 68, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED that a public hearing be held within said Special Benefit Subdistrict to afford all persons interested in said improvement an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution; and that notice of such hearing shall be given by the posting of notices in not less than three public places within the boundaries of said Special Benefit Subdistrict. The foregoing Resolution was adopted January 22, 1959.
