R E S O L U T I O N NO. 226
WHEREAS, the Board has received a petition from
property owners in St. Louis County for the construction of
sanitary sewers to serve such area, and
WHEREAS, investigation has shown that such area is not
adequately served by such sewers and that the public health is
affected, and
WHEREAS, it is estimated that the probable cost of
installation of such sewers will be approximately Two Hundred
Eighty Thousand Dollars ($280,000.00) and that the most
practicable method of payment therefor is by special tax bills, or
other evidence of special benefit assessments upon the land
benefited by such installation,
NOW, THEREFORE, BE IT RESOLVED that the construction of
adequate lateral sanitary sewers in the area described below is
necessary in the interest of the public health; that such sewers
shall consist of approximately 2,100 lineal feet of 10 inch and
36,350 lineal feet of 8 inch vitrified clay pipe, which shall be
capable of efficiently serving or draining the entire local
drainage area; that the estimated probable cost of such
improvement is Two Hundred Eighty Thousand Dollars ($280,000.00);
that the entire cost of such improvement shall be paid for by
special tax bills or other evidence of special benefit assessments
upon the land benefited by such improvement; and that such
improvement be constructed in St. Louis County in the area
described as follows:

Beginning at the point of intersection of the
centerline of Chambers Road, 60 feet wide, and the southerly
prolongation of the western line of that part of Lot 1 of Block 2
of Bendemeer Acres Subdivision as recorded in Plat Book 23 on Page
33 of the St. Louis County Records, as described in a deed to
Irving and Francis Olian, Recorded In Book 3858, Page 189, St.
Louis County Recorders Office; thence in a northerly direction
along said line and prolongation thereof to the southern line of
Lot 2 of said Bendemeer Acres Subdivision; thence in an easterly
direction along said southern line of Lot 2 to its southeastern
corner; thence eastwardly in a straight line across North
Floridale Avenue, 40 feet wide to the northwest corner of Lot 1 of
Block 1 of said Bendemeer Acres Subdivision; thence in an easterly
direction along the northern line of said Lot 1 a distance of 125
feet to a point, said point also being a distance of 125 feet in a
westerly direction along the northern line of said Lot 1 from the
western line of West Florissant Avenue, 60 feet wide; thence in a
northerly direction along a line parallel to the western line of
West Florissant Avenue, 60 feet wide, to a point in the southern
line of Ferguson Acres Subdivision, said line parallel to the
western line of West Florissant Avenue being common with the
eastern line of Lots 1, 2, 3 and 4 of Heydt Subdivision as
recorded in Plat Book 35 on Page 90 of the St. Louis County

Records; thence in a westerly direction along the southern line of
Ferguson Acres Subdivision as recorded in Plat Book 46 on Page 14
of the St. Louis County Records to the southeast corner of Lot 9
in said Ferguson Acres Subdivision; thence northwardly along the
eastern line of said Lot 9 to the southern line of Kroeger Drive;
thence westwardly along the southern line of Kroeger Drive to its
intersection with the southern prolongation of the western line of
Lot 35 of said subdivision; thence northwardly along said
prolongation across Kroeger Drive and along the western line of
said Lot 35 to the most southern corner of Lot 36 of said
subdivision; thence northwestwardly along the southwestern lines

northernmost line of Lots 10, 9 and 8 of said subdivision to the
southwestern corner of a tract of land described in deed to
Raymond and Odie Kirchmeyer, recorded in Book 3409, Page 36, St.
Louis County Records; thence in a northerly direction along the
Western boundary of said tract and a northerly prolongation
thereof to the centerline of Chambers Road, 60 feet wide,; thence
in a westerly direction along the centerline of Chambers Road to
the point of beginning.

such facilities to flow into or be connected with existing lateral
sanitary sewers located at two points, each situated approximately
200 feet outside the aforementioned area, which area shall be the
area benefited by such improvement and which is hereby designated
as Special Benefit Subdistrict No. 69 (City of Dellwood) of The
Metropolitan St. Louis Sewer District.
BE IT FURTHER RESOLVED that special benefit assessments
for the entire cost of such improvement be levied against all land
in the above described Special Benefit Subdistrict No. 69, whether
public or private, in the proportion that each such lot or parcel
of land bears to the entire benefited area of such Special Benefit
Subdistrict No. 69, exclusive of public streets, roads and alleys.
BE IT FURTHER RESOLVED that
a public hearing be held within said Special Benefit Subdistrict
to afford all persons interested in said improvement an
opportunity to be heard; that such hearing shall be held at such
time and place as the Executive Director shall determine, but not
less than ten nor more than thirty days after the adoption of this
resolution; and that notice of such hearing shall be given by the
posting of notices in not less than three public places within the
boundaries of said Special Benefit Subdistrict.
The foregoing Resolution was adopted January 22, 1959.
