HomeMy Public PortalAboutR0226REPEALED BY RESOLUTION NO. 240 - 4/30/59 R E S O L U T I O N NO. 226 WHEREAS, the Board has received a petition from property owners in St. Louis County for the construction of sanitary sewers to serve such area, and WHEREAS, investigation has shown that such area is not adequately served by such sewers and that the public health is affected, and WHEREAS, it is estimated that the probable cost of installation of such sewers will be approximately Two Hundred Eighty Thousand Dollars ($280,000.00) and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land benefited by such installation, NOW, THEREFORE, BE IT RESOLVED that the construction of adequate lateral sanitary sewers in the area described below is necessary in the interest of the public health; that such sewers shall consist of approximately 2,100 lineal feet of 10 inch and 36,350 lineal feet of 8 inch vitrified clay pipe, which shall be capable of efficiently serving or draining the entire local drainage area; that the estimated probable cost of such improvement is Two Hundred Eighty Thousand Dollars ($280,000.00); that the entire cost of such improvement shall be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement; and that such improvement be constructed in St. Louis County in the area described as follows: 2 (SEE NEXT PAGE) 3 City of Dellwood Subdistrict Beginning at the point of intersection of the centerline of Chambers Road, 60 feet wide, and the southerly prolongation of the western line of that part of Lot 1 of Block 2 of Bendemeer Acres Subdivision as recorded in Plat Book 23 on Page 33 of the St. Louis County Records, as described in a deed to Irving and Francis Olian, Recorded In Book 3858, Page 189, St. Louis County Recorders Office; thence in a northerly direction along said line and prolongation thereof to the southern line of Lot 2 of said Bendemeer Acres Subdivision; thence in an easterly direction along said southern line of Lot 2 to its southeastern corner; thence eastwardly in a straight line across North Floridale Avenue, 40 feet wide to the northwest corner of Lot 1 of Block 1 of said Bendemeer Acres Subdivision; thence in an easterly direction along the northern line of said Lot 1 a distance of 125 feet to a point, said point also being a distance of 125 feet in a westerly direction along the northern line of said Lot 1 from the western line of West Florissant Avenue, 60 feet wide; thence in a northerly direction along a line parallel to the western line of West Florissant Avenue, 60 feet wide, to a point in the southern line of Ferguson Acres Subdivision, said line parallel to the western line of West Florissant Avenue being common with the eastern line of Lots 1, 2, 3 and 4 of Heydt Subdivision as recorded in Plat Book 35 on Page 90 of the St. Louis County 4 Records; thence in a westerly direction along the southern line of Ferguson Acres Subdivision as recorded in Plat Book 46 on Page 14 of the St. Louis County Records to the southeast corner of Lot 9 in said Ferguson Acres Subdivision; thence northwardly along the eastern line of said Lot 9 to the southern line of Kroeger Drive; thence westwardly along the southern line of Kroeger Drive to its intersection with the southern prolongation of the western line of Lot 35 of said subdivision; thence northwardly along said prolongation across Kroeger Drive and along the western line of said Lot 35 to the most southern corner of Lot 36 of said subdivision; thence northwestwardly along the southwestern lines of Lot 36 and 37 of said subdivision to the southwestern corner of said Lot 37 and continuing northwardly along the western line of said Lot 37 to the southern line of Thatcher Avenue; thence northwardly in a straight line across Thatcher Avenue to the southwestern corner of Lot 72 of said subdivision and continuing northwardly along the western line of said Lot 72 to the southern line of Lot 91 of said subdivision; thence westwardly along the southern line of said Lot 91 to its southwestern corner; thence northwardly along the western line of said Lot 91 to the southern line of Steins Road; thence westwardly along the southern line of Steins Road to its intersection with the southern prolongation of the eastern line of tract described in deed to Carl C. Zwick, recorded in Book 2022, Page 226, of St. Louis County Records; thence northwardly along said prolongation across Steins Road and 5 along the eastern line of said Zwick tract to a point distant 200 feet northwardly from the northern line of Steins Road, 40 feet wide; thence westwardly along a line 200 feet north of and parallel to the northern line of Steins Road to the western line of said Zwick tract; thence westwardly in a straight line to a point in the western line of a tract described in deed to John Marco, recorded in Book 3376, Page 339, St. Louis County Recorder's Office, said point being 310 feet northwardly from the northern line of Steins Road, 40 feet wide; thence westwardly and parallel with the Northern line of Steins Road to the eastern line of tract described in deed to Lloyd D. Goodson, recorded in Book 2518, Page 423, St. Louis County Recorder's Office; thence northwardly along the eastern line of said Goodson tract to its northeastern corner; thence in a westwardly direction along the northern line of said Goodson tract to its intersection with a line parallel to and 200 feet west of the east line of said Goodson property; thence in a southerly direction along said parallel line to its intersection with the centerline of Stein Avenue, 40 feet wide; thence in a southwesterly direction along said centerline to its intersection with the northwesterly prolongation of the southwesterly line of Lot 103 of said Ferguson Acres Subdivision; thence in a southeasterly direction along said prolongation and along said line to the southwestern corner of said Lot 103; thence in an easterly direction along the southern line of Lots 103, 102 and 101 of said Ferguson Acres Subdivision 6 to the southeastern corner of said Lot 101; thence in a southerly direction along the eastern line of Lot 61 of said subdivision to the northern line of Thatcher Avenue, 50 feet wide; thence southwardly in a straight line across Thatcher Avenue to the northeastern corner of Lot 47 of said Ferguson Acres Subdivision; thence in a southerly direction along the eastern line of said Lot 47 and Lot 23 of said subdivision and a southerly prolongation thereof to the centerline of Kroeger Drive, 50 feet wide; thence in an easterly direction along said centerline to the point of intersection with the northerly prolongation of the eastern line of Lot 18 of said Ferguson Acres Subdivision; thence in a southerly direction along said prolongation and along said line to the southeastern corner of said Lot 18, said corner being in the southern line of said Ferguson Acres Subdivision; thence in an easterly direction along the southerly line of said subdivision to its intersection with the centerline of Schlueter Avenue, 40 feet wide; thence in a southerly direction along said centerline of Schlueter Avenue to its intersection with the easterly prolongation of the centerline of Wedge Drive, 50 feet wide; thence westwardly along said prolongation and along said centerline of Wedge Drive to its intersection with the northerly prolongation of the western line Lot 7 of Wedgewood Subdivision as recorded in Plat Book 39 on Page 63 of the St Louis County Records; thence in a southerly direction along said prolongation and along the West line of Lots 7, 8, 9, 10, 11 and 12 of said 7 Wedgewood Subdivision to the southwesterly corner of Lot 12; thence in an easterly direction along the southern line of said Lot 12 to the northwestern corner of Lot 13 of Wedgewood Subdivision; thence in a southerly direction along the western boundary of Lots 13 and 14 of said Wedgewood Subdivision to the southwestern corner of said Lot 14; thence in an easterly direction along the southern line of said Lot 14 and an easterly prolongation thereof to the centerline of Schlueter Avenue, 40 feet wide; thence in a southerly direction along the centerline of Schlueter Avenue and a southerly prolongation thereof to the centerline of Chambers Road, 60 feet wide; thence in a westerly direction along the centerline of Chambers Road to the point of intersection with the northerly prolongation of the centerline of that part of Schlueter Avenue being South of Chambers Road; thence in a southerly direction along the centerline of Schlueter Avenue to the point of intersection with the easterly prolongation of the southern line of Lot 2 of Chambers Heights Subdivision as recorded in Plat Book 15, Page 141 of the St. Louis County Records; thence in a westerly direction along said prolongation and along said lot line to the East line of Lot 1 of said subdivision; thence in a southerly direction along the Eastern line of said Lot 1 to its southeastern corner, said corner also being in the Northern line of Lot 4 of said Chambers Heights Subdivision; thence in a westerly direction along the Northern line of said Lot 4 to the Western line of Chambers Heights Subdivision; thence in a 8 southerly direction along said Western line to the southwestern corner of Lot 17 of said Chambers Heights Subdivision; thence in an easterly direction along the southern line of said Lot 17 to the southeast corner of said Lot 17; thence eastwardly across Schlueter Avenue to the southwest corner of a lot now or formerly owned by Martin H. and Esther Heyn as recorded in Deed Book 1622 on Page 572 of the St. Louis County Records; thence eastwardly along the South line of said Heyn property and said line produced eastwardly to its intersection with the southward prolongation of the West line of Westwood Acres Subdivision as recorded in Plat Book 68 on Page 27 of the St. Louis County Records; thence northwardly along said prolongation and along said West line to the northwest corner of said subdivision; thence eastwardly along the North line of said subdivision to the northeast corner of said subdivision; thence southwardly along the easternmost lines of Lots 13 through 7 of said subdivision to the northwest corner of Lot 5 of said subdivision; thence eastwardly along the North line of Lots 5, 4 and 3 of said subdivision to its intersection with the southward prolongation of the West line of a tract now or formerly owned by the Doctor's North Roads Building, incorporated as recorded in Deed Book 3518 on Page 122 of the St. Louis County Records; thence northwardly along said prolongation and along said West line to the South line of Dunmore Court Addition subdivision as recorded in Plat Book 51 on Page 13 of the St. Louis County Records; thence in an easterly direction along the Southern line 9 of Dunmore Court addition to the southwestern corner of Lot 20 of said addition; thence in a northerly direction along the Western line of Lots 20, 19, 18 and 17 of said addition to the northwestern corner of Lot 17, said corner being on the Southern line of a tract of land described in a deed to Alfred H. and Marie Thies, recorded in Book 728, Page 431, St. Louis County Records; thence northwardly across said Thies tract along a line to the centerline of Thies Drive, 50 feet wide, said line passing through a point on the Northern line of Thies tract 170 feet in a westerly direction from the northeast corner of said Thies tract; thence northwardly across Thies Drive to the southwest corner of Lot 19 of Dunmore Court Subdivision as recorded in Plat Book 46 on Page 36 of the St. Louis County Records; thence in a northerly direction along the Western line of said Lot 19 to the northwestern corner of said Lot 19; thence northeastwardly, northwardly and northwestwardly along the easternmost and northernmost line of Lots 10, 9 and 8 of said subdivision to the southwestern corner of a tract of land described in deed to Raymond and Odie Kirchmeyer, recorded in Book 3409, Page 36, St. Louis County Records; thence in a northerly direction along the Western boundary of said tract and a northerly prolongation thereof to the centerline of Chambers Road, 60 feet wide,; thence in a westerly direction along the centerline of Chambers Road to the point of beginning. 10 such facilities to flow into or be connected with existing lateral sanitary sewers located at two points, each situated approximately 200 feet outside the aforementioned area, which area shall be the area benefited by such improvement and which is hereby designated as Special Benefit Subdistrict No. 69 (City of Dellwood) of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED that special benefit assessments for the entire cost of such improvement be levied against all land in the above described Special Benefit Subdistrict No. 69, whether public or private, in the proportion that each such lot or parcel of land bears to the entire benefited area of such Special Benefit Subdistrict No. 69, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED that a public hearing be held within said Special Benefit Subdistrict to afford all persons interested in said improvement an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution; and that notice of such hearing shall be given by the posting of notices in not less than three public places within the boundaries of said Special Benefit Subdistrict. The foregoing Resolution was adopted January 22, 1959.
