HomeMy Public PortalAboutR0229REPEALED 11/5/59 - SEE RESOLUTION NO. 272 R E S O L U T I O N NO. 229 WHEREAS, the Board has received a petition from property owners in St. Louis County for the construction of storm sewers to serve such area, and WHEREAS, investigation has shown that such area is not adequately served by such sewers and that the public health is affected, and WHEREAS, it is estimated that the probable cost of installation of such sewers will be approximately Forty Thousand Dollars ($40,000.00) and that the most practicable method of payment therefor is by special tax bills, or other evidence of special benefit assessments upon the land benefited by such installation, NOW, THEREFORE, BE IT RESOLVED that the construction of adequate storm water drains and storm sewers in the area described below is necessary in the interest of the public health; that such sewers shall consist of approximately 800 lineal feet of pipe ranging from 18 inches to 30 inches in diameter, which shall be capable of efficiently serving or draining the entire local drainage area; that the estimated probable cost of such improvement is Forty Thousand Dollars ($40,000.00); that the entire cost of such improvement shall be paid for by special tax bills or other evidence of special benefit assessments upon the land benefited by such improvement; and that such improvement be constructed in St. Louis County in the area described as follows: (SEE NEXT PAGE) 2 ZENITH COURT Beginning at a point in the West line of Zenith Court, 50 feet wide, with the intersection of the line dividing Lots 7 and 8 of St. George Court Subdivision as recorded in Plat Book 66 on Page 6 of the St. Louis County Records; thence Eastwardly and perpendicular to said Zenith Court 35 feet to a point; thence Northeastwardly to a point in Lot 18 of said Subdivision being distant 30 feet East of the East line of said Zenith Court and 14 feet North of the South line of said Lot 18; thence along a line 14 feet North of and parallel to the South line of said Lot 18 Eastwardly 26 feet to a point, thence along a line 56 feet East of and parallel to the East line of said Zenith Court, Northwardly 190 feet to a point in Lot 19 of said Subdivision; thence Eastwardly to a point in the West line of Reavis Gardens No. 2 Subdivision as recorded in Plat Book 72 on Page 26 of the St. Louis County Records said point being the intersection of said West line with the line dividing Lots 238 and 239 of said Reavis Gardens No 2; thence along a line 30 feet West of and parallel to the East line of said Lot 8, Northwardly 74 feet to a point; thence Northeastwardly to the point of beginning; 9 such facilities to flow into or be connected with existing storm water drains and storm sewers located at the boundary of the aforementioned area, which area shall be the area benefited by such improvement and which is hereby designated as Special Benefit Subdistrict No. 71 (Zenith Court) of The Metropolitan St. Louis Sewer District. BE IT FURTHER RESOLVED that special benefit assessments for the entire cost of such improvement be levied against all land in the above described Special Benefit Subdistrict No. 71, whether public or private, in the proportion that each such lot or parcel of land bears to the entire benefited area of such Special Benefit Subdistrict No. 71, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED that a public hearing be held within said Special Benefit Subdistrict to afford all persons interested in said improvement an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution; and that notice of such hearing shall be given by the posting of notices in not less than three public places within the boundaries of said Special Benefit Subdistrict. The foregoing Resolution was adopted on February 12, 1959.
