WHEREAS, there exist within The Metropolitan St. Louis
Sewer District and within the City of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenance,
and which it is desirable for the District to operate and
maintain, and,
WHEREAS, the District by Ordinance Number 88, adopted
the 16th day of July, 1956, is authorized to assume title to any
or all sewers, easements and appurtenances by Resolution whenever,
in the opinion of counsel, no person competent to convey title can
be found, and upon recommendation of the Executive Director that
the District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers, and the Executive Director
recommends that the District should assume title to such sewers,
NOW, THEREFORE, BE IT RESOLVED that title to the
following described sewers and their appurtenances in the City of
St. Louis be and are hereby assumed by The Metropolitan St. Louis
Sewer District for public use, operation and maintenance:
1. That sewer constructed under Permit No. 50054 and
lying in Newby Street between the City Limits and a public sewer
on the southeast side of Riverview Boulevard.
2. That sewer constructed under Permit No. 50054 and
lying in Dischinger Court.

3. Those sewers constructed under Permit No. 50054
and lying in Edna Street between the City Limits and Melvin
Avenue, and lying in Melvin Avenue between Edna Street and Newby
Street.
4. Those sewers constructed under Permit No. 50054
and lying in easements in Block 1 of Riverview Terrace, a
Subdivision of the City of St. Louis according to the plat thereof
recorded in Plat Book 26, page 28 of the City of St. Louis
Records, which is a portion of City Block 6311 of the City of St.
Louis.
5. That sewer constructed under Permit No. 50054 and
lying in the north side of Riverview Boulevard and extending from
the west line of Lot 1, Block 1 of aforesaid Riverview Terrace
Subdivision to Newby Street.

The foregoing Resolution was adopted on April 9, 1959.
