WHEREAS, the Board received a petition from property
owners in St. Louis County for the construction of storm sewers to
serve such area, and
WHEREAS, investigation has shown that such area is not
adequately served by such sewers and that the public health is
affected, and
WHEREAS, the Board created Special Benefit Subdistrict
No. 71 (Zenith Court) by Resolution No. 229 adopted February 12,
1959 in response to such petition, and
WHEREAS, further investigation shows a necessity to
revise the boundaries of such subdistrict, and
WHEREAS, it is estimated that the probable cost of
installation of such sewers will be approximately Forty Thousand
Dollars ($40,000.00), and that the most practicable method of
payment therefor is by special tax bills, or other evidence of
special benefit assessments upon the land benefitted by such
installation,
NOW, THEREFORE, BE IT RESOLVED that Resolution No. 229,
adopted February 12, 1959, be and the same hereby is repealed.
BE IT FURTHER RESOLVED, that the construction of
adequate stormwater drains and storm sewers in the area described
below is necessary in the interest of the public health; that such
sewers shall consist of approximately 800 lineal feet of pipe
ranging from 18 inches to 30 inches in diameter, which shall be
capable of efficiently serving or draining the entire local
drainage area; that the estimated probable cost of such
improvement is Forty Thousand Dollars ($40,000.00); that the
entire cost of such improvement shall be paid for by special tax
bills or other evidence of special benefit assessments upon the
land benefitted by such improvement; and that such improvement be
constructed in St. Louis County in the area described as follows:

ZENITH COURT
Beginning at a point in the centerline of Zenith Court,
50 feet wide, with the intersection of a line parallel to and 72
feet south of the south line of Lot 19 of St. George Court
Subdivision as recorded in Plat Book 66 on Page 6 of the St. Louis
County Records; thence eastwardly along said parallel line 85 feet
to a point; thence northwardly along a line parallel to and 85'
east of the centerline of said Zenith Court to a point 48 feet
north of the south line of Lot 20 of said subdivision; thence
northeastwardly in a straight line to a point in the south line of
Lot 21 of said subdivision distant 131 feet east of the east line
of Zenith Court as measured along said south line; thence

northeastwardly to the point of beginning; such facilities to flow
into or be connected with existing stormwater drains and storm
sewers located at the boundary of the aforementioned area, which
area shall be the area benefitted by such improvement and which is
hereby designated as Special Benefit Subdistrict No. 71 (Zenith
Court) of The Metropolitan St. Louis Sewer District.
BE IT FURTHER RESOLVED, that special benefit
assessments for the entire cost of such improvement be levied
against all land in the above described Special Benefit

Subdistrict No. 71, whether public or private, in the proportion
that each such lot or parcel of land bears to the entire
benefitted area of such Special Benefit Subdistrict No. 71,
exclusive of public streets, roads and alleys.
BE IT FURTHER RESOLVED, that a public hearing be held
within said special benefit subdistrict to afford all persons
interested in such improvement an opportunity to be heard; that
such hearing shall be held at such time and place as the Executive
Director shall determine, but not less than ten nor more than
thirty days after the adoption of this resolution; and that notice
of such hearing shall be given by the posting of notices in not
less than three public places within the boundaries of said
special benefit subdistrict.
