HomeMy Public PortalAboutR0294 R E S O L U T I O N NO. 294 WHEREAS, by Section 3.010 of the Plan of The Metropolitan St. Louis Sewer District, it is provided that on July 1, 1954, by virtue of the adoption of the Plan by the vote of the people of the City of St. Louis and St. Louis County, the District shall take over certain sewer facilities; and WHEREAS, pursuant to said Section 3.010 of the Plan, the Board of Trustees of The Metropolitan St. Louis Sewer District adopted Resolution No. 6 on July 1, 1954, recorded in Book 3286, Page 90 of the St. Louis County Records, which resolution assumed title to all public sewer facilities of any and all municipalities, sewer districts, and other public agencies situated within the boundaries of the District, including, among others, the property of the St. Johns-Overland Sanitary Sewer District known as the "St. Johns-Overland Sewer Treatment Plant property"; and WHEREAS, this District wishes to assert and declare more specifically its title to such property, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that the title to the hereinafter described property is vested in The Metropolitan St. Louis Sewer District by virtue of the adoption of aforesaid Resolution No. 6 by the Board of Trustees of The Metropolitan St. Louis Sewer District on July 1, 1954, under the authority of Section 3.010 of the Plan of The Metropolitan St. Louis Sewer District, and such property is under the possession, jurisdiction and control of this District, and that public notice thereof is hereby reasserted: That property conveyed by Mary E. Frame to the St. Johns-Overland Sanitary Sewer District by instrument dated June 26, 1939 and recorded in Book 1583, Page 266 of the St. Louis County Records, being a tract of land in U. S. Surveys 166 and 167, Township 46N, Range 6E, St. Louis County, Missouri, and more particularly described as follows: Beginning at the intersection of the eastern line of Wright Avenue, 30 feet wide, a plat of which dedication is of record in Plat Book 15, Page 38 of the St. Louis County Records, with the south line of a 15 foot road known as Livingston Avenue, thence along the east line of said Wright Avenue south 7 degrees 49 minutes west 320 feet to the center of an easement of the Coldwater Creek Drainage District; thence along the centerline of said easement south 26 degrees 21-1/2 minutes east 806.42 feet to a point; thence leaving said easement line and running north 7 degrees 49 minutes east 945 feet to an old stone in the south line of said Livingston Avenue 15 feet wide; thence along the south line of said Avenue north 76 degrees 52 minutes west 454.92 feet to the place of beginning. Containing 6.577 acres, more or less. The foregoing Resolution was adopted March 3, 1960.
