WHEREAS, the Board has received a petition from
property owners in the area of Ashby Road and Page Boulevard in
St. Louis County for the construction of lateral sanitary sewers
to serve such area, and
WHEREAS, investigation has shown that such area is not
adequately served by lateral sanitary sewers and that the public
health is affected, and
WHEREAS, by Resolution No. 142 adopted August 26, 1957
and readopted by Resolution No. 146, a benefit subdistrict was
created to be known as Special Benefit Subdistrict No. 36 (West
Iveland Lateral) for the construction of such sewers at a probable
cost then estimated to be One Hundred Sixty-eight Thousand Dollars
($168,000.00); and
WHEREAS, it is now estimated that the probable cost of
installation of such sewers will be approximately Two Hundred
Thirty Thousand Dollars ($230,000.00), and that the most
practicable method of payment therefor is by special tax bills, or
other evidence of special benefit assessments upon the land
benefitted by such installation,
NOW, THEREFORE, BE IT RESOLVED that said Resolution No.
142 as readopted by Resolution No. 146 be and the same hereby is
repealed.
BE IT FURTHER RESOLVED, that a benefit subdistrict to
be known as Special Benefit Subdistrict No. 36 (West Iveland
Lateral) of The Metropolitan St. Louis Sewer District be and the
same is hereby recreated for the purpose of constructing lateral
sanitary sewers in the area of Ashby Road and Page Boulevard in
St. Louis County, said area being more particularly described as
follows:
Beginning at a point of intersection of the centerlines
of Warson Link Road and Trenton Avenue, said point being a point
on the western boundary line of the Metropolitan St. Louis Sewer
District, and said Trenton Avenue being the south boundary line of
the Page Link Subdivision, a tract of land located in U. S. Survey
3042 as shown in Plat Book 16, Page 53 in the St. Louis County
Assessors Office; thence northwardly along the centerline of
Warson Link Road common with the Metropolitan St. Louis Sewer
District boundary line to its intersection with the centerline of
Page Avenue; thence westwardly along said centerline of said Page
Avenue to its intersection with the southward prolongation of the
west lines of Lots 17 through 21 of Lackland Park Subdivision as
recorded in Plat Book 17 on Page 8 in the St. Louis County
Recorder of Deeds Office; thence northwardly along said prolonged
line and along said west lines of Lots 17 through 21 to the
northwest corner of said Lot 21; thence eastwardly along the north
line of said Lot 21 and said line produced eastwardly to its
intersection with the centerline of Warson Link Road; thence
northwardly along said centerline of Warson Link Road to its
intersection with the southwestwardly prolongation of the
northernmost line of Lots 14 and 13 of Block 1 of West Forest View
Subdivision as recorded in Plat Book 14 on Page 76 in the St.
Louis County Recorder of Deeds Office; thence northeastwardly

along said prolongation and along said northernmost lines of Lots
14 and 13 to the northeast corner of said Lot 13, said corner
being also the southwest corner of Lot 3 of said Block 1; thence
northwardly along the west line of said Lot 3 and said line
produced northwardly to its intersection with the centerline of
Lackland Avenue; thence northeastwardly along the centerline of
Lackland Avenue to its intersection with the northward
prolongation of the east line of Lot 2 of Forest View Subdivision
as recorded in Plat Book 12 on Page 145 in the St. Louis County
Recorder of Deeds Office; thence southwardly along said
prolongation and along said east line of said Lot 2 to the
southeast corner of said Lot 2; thence eastwardly along the south
line of Lot 3 of said Forest View Subdivision and said line
produced eastwardly to its intersection with the centerline of
Lake Avenue (50 feet wide); thence southwardly along the
centerline of Lake Avenue to its intersection with the westward
prolongation of the south line of Lots 21, 22 and 23 of said
Forest View Subdivision; thence eastwardly along said prolongation
and along said south line of said Lots 21, 22 and 23 to the
southeast corner of said Lot 23; thence southwardly along the east
line of Lot 26 of said Forest View Subdivision and said line
produced southwardly to its intersection with the centerline of
Oak Avenue (50 feet wide); thence westwardly along the centerline
of Oak Avenue to its intersection with the centerline of Morven
Avenue (50 feet wide); thence southwardly along said centerline of
Morven Avenue to its intersection with the westward prolongation

of the south line of Lot 1 of the Ross Mason Subdivision, as
recorded in Plat Book 17 on Page 88 of the St. Louis County
Records; thence eastwardly along said prolongation and along said
south line to its intersection with the east boundary line of said
Ross Mason Subdivision; thence southwardly along said east
boundary line of said Ross Mason Subdivision and said line
projected southwardly to its intersection with the centerline of
Page Boulevard; thence eastwardly along the centerline of Page
Boulevard to its intersection with the northward prolongation of a
lot line, said line being 220 feet east of and parallel to the
east line of Fairview Avenue; thence southwardly along said
prolongation and along said parallel line to its intersection with
a property line, said line being 405.75 feet south of and parallel
to the south line of Page Boulevard; thence westwardly along the
last described property line and said line projected westwardly to
its intersection with the centerline of Fairview Avenue; thence
southwardly along said centerline of said Fairview Avenue and
along its southward prolongation a distance of 377.11 feet more or
less to the centerline of Trenton Avenue; thence westwardly along
the centerline of said Trenton Avenue to the point of beginning.
BE IT FURTHER RESOLVED, that the construction of
adequate lateral sanitary sewers in the area known as Subdistrict
No. 36 (West Iveland Lateral) is necessary in the interest of the
public health; that such sewers shall consist of approximately
18,435 lineal feet of 8-inch pipe, which shall be capable of
efficiently serving or draining the entire local drainage area;

that the estimated probable cost of such improvement is Two
Hundred Thirty Thousand Dollars ($230,000.00); that the entire
cost of such improvement shall be paid for by special tax bills or
other evidence of special benefit assessments upon the land
benefitted by such improvement; and that such improvement be
constructed in said subdistrict, such facilities to flow into or
be connected with an existing public trunk sanitary sewer located
in Special Benefit Subdistrict No. 35, as described in Resolution
No. 141.
BE IT FURTHER RESOLVED, that special benefit
assessments for the entire cost of such improvement be levied
against all land in the above described Special Benefit
Subdistrict No. 36, whether public or private, in the proportion
that each such lot or parcel of land bears to the entire
benefitted area of such subdistrict, exclusive of public streets,
roads and alleys.
BE IT FURTHER RESOLVED, that a public hearing be held
within said subdistrict to afford all persons interested in said
improvement an opportunity to be heard; that such hearing shall be
held at such time and place as the Executive Director shall
determine, but not less than ten nor more than thirty days after
the adoption of this resolution; and that notice of such hearing
shall be given by the publication of notice in at least one issue
of a newspaper of general circulation within The Metropolitan St.
Louis Sewer District not less than ten days in advance of the date
of such hearing.
