WHEREAS, there exist within The Metropolitan St.Louis
Sewer District and within the City of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenance,
and which it is desirable for the District to operate and
maintain, and
WHEREAS, the District by Ordinance Number 88, adopted
the 16th day of July, 1956, is authorized to assume title to any
or all sewers, easements and appurtenances by resolution whenever,
in the opinion of counsel, no person competent to convey title can
be found, and upon recommendation of the Executive Director that
the District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers and easement and the Executive
Director recommends that the District should assume title to such
sewers and easement,
NOW, THEREFORE, BE IT RESOLVED, that title to the
following described sewers and their appurtenances and easement in
the City of St. Louis be and are hereby assumed by The
Metropolitan St. Louis Sewer District for public use, operation
and maintenance:
1. That sewer constructed under Permit No. 66114 and
lying in the River des Peres right-of-way in or adjacent to City
Block 4696.
2. Those sewers constructed under Permit No. 26559
and lying in Allemania Street between Stolle Street and the River
des Peres right-of-way.
3. That sewer constructed under Permit No. 28152 and
lying in Schroeder Place between Allemania Street and City Block
4695.
4. That sewer constructed under Permit No. 21540 and
lying in Tesson Street between Stolle Street and the River des
Peres right-of-way.
5. That sewer constructed under Permit No. 21540 and
lying in Primm Street between Stolle Street and a manhole
approximately 280 feet north of the River des Peres right-of-way.
6. That sewer constructed under Permit No. 21540 and
lying in a private easement in City Block 5996 between Tesson
Street and Primm Street, together with an easement for sewer and
drainage purposes over such private easement. The foregoing Resolution was adopted October 7, 1960.
