WHEREAS, public sewers now in operation lie in the
north-south alley 20 feet wide in City Block 603 of the City of
St. Louis, the north 160 feet of which alley was vacated by
Ordinance No. 49626 of the City of St. Louis, adopted November 10,
1959, and in the north-south alley 20 feet wide in City Block 610
of the City of St. Louis, which alley was vacated by Ordinance No.
40908 of the City of St. Louis, adopted July 8, 1936, and in
former Mullanphy Street from Ninth Street to Tenth Street, which
street was vacated by Ordinance No. 50007 of the City of St.
Louis, adopted June 8, 1960, which Ordinance reserves an easement
for sewer purposes over such vacated portions of street and alley,
and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct buildings in said easement
strips and over said sewers and examination of the plans and
specifications of such proposed buildings show that they would not
damage the existing sewers,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strips, provided that
the right of the District to use the easement strips is preserved,
that the owner agrees to maintain such sewers, and under suitable
indemnity provisions.
The foregoing Resolution was adopted November 23, 1960.
