WHEREAS, a public sewer now in operation lies in a
sewer easement twenty feet wide as granted by instrument recorded
in Book 2466, page 456 of the St. Louis County Records, and which
easement extends northwardly from Washington Street in the City of
Florissant, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building over a concrete
slab located in said easement strip and over said sewer, and
examination of the plans and specifications of such proposed
building shows that it would not damage the existing sewer, and
WHEREAS, said sewer would be relocated at such time as
the Coldwater Creek Trunk Sewer is constructed,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strip, subject to
revocation whenever it reasonably appears that the public interest
would be served by such revocation, provided that the right of the
District to use the easement strip is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted December 22, 1960.
