WHEREAS, a public sewer now in operation lies in a
sewer easement in a strip of ground over the former east-west
alley in City Block 508 of the City of St. Louis, which alley was
vacated by Ordinance 47,994 of the City of St. Louis, approved
July 12, 1956,and by which ordinance the City reserved an easement
for sewer purposes to this District, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a cooling tower, a roof
shelter and a screen wall in said easement strip and over said
sewer, and examination of the plans and specifications of such
proposed structures shows that they would not damage the existing
sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strip, subject to
revocation whenever it reasonably appears that the public interest
would be served by such revocation, provided that the right of the
District to use the easement strip is preserved and under suitable
indemnity provisions.
The foregoing Resolution was adopted December 22, 1960.
