HomeMy Public PortalAboutR0504 R E S O L U T I O N NO. 504 WHEREAS, proposed Ordinance No. 79-62 was introduced to establish Subdistrict No. 181 (Bataan and Boswell) for the purpose of extending the public sewer system by acquiring, extending and improving a private sanitary sewer system now or formerly owned by Town Service, Inc., at the expense of such subdistrict, the boundaries of which were delineated in said proposed ordinance, and WHEREAS, those persons interested who attended a public hearing on said proposed ordinance, held Monday, January 15, 1962, at 8:00 o'clock p.m. at the Kratz School, 4301 Edmundson Road, St. Louis County, Missouri, were in favor of establishing such subdistrict, and said proposed ordinance has been duly enacted as Ordinance No. 699, and WHEREAS, investigation has shown that the area of such Subdistrict No. 181 (Bataan and Boswell) can not be efficiently served by both private and public sanitary sewer systems, that the public sewer system can be extended by purchase of said private system, and that the public health and welfare can be better protected by a public system, and WHEREAS, it is estimated that the probable cost of extending the public sewer system by purchasing said private system will be approximately Twenty-One Thousand One Hundred Twenty Dollars ($21,120.00), of which Nineteen Thousand Two Hundred Dollars ($19,200.00), is the agreed purchase price and the remainder is the estimated sum required to be advanced by the District for necessary expenses incident to such purchase, and 3 WHEREAS, the most practicable method of payment for said private sewer system is by special tax bills or other evidence of special benefit assessments on the land benefitted by such purchase, NOW, THEREFORE, BE IT RESOLVED that the extension of the public sewer system by the purchase of a private sanitary sewer system in the area known as Subdistrict No. 181 (Bataan and Boswell) from Town Service, Inc, its successors or assigns, is necessary in the interest of the public health and welfare; that such private system consists of lateral sanitary sewers and appurtenances of adequate capacity, together with appropriate easements for sewer purposes and all other rights, whether within or without said subdistrict, necessary to provide sanitary sewer service to the land within said subdistrict; that the estimated probable cost of such purchase is Twenty-one Thousand One Hundred Twenty Dollars ($21,120.00); and that the entire cost thereof shall be paid for by special tax bills or other evidence of special benefit assessments upon the land within the boundaries of such subdistrict all of which will be benefitted by such purchase and extension of the public sewer system. BE IT FURTHER RESOLVED, that special benefit assessments for the entire cost of such purchase be levied against all lots or parcels of land in the above described subdistrict, whether public or private, in equal proportion per lot, exclusive of public streets, roads and alleys. BE IT FURTHER RESOLVED, that a public hearing be held 4 within said subdistrict to afford all persons interested in said purchase an opportunity to be heard; that such hearing shall be held at such time and place as the Executive Director shall determine, but not less than ten nor more than thirty days after the adoption of this resolution, and that notice of such hearing shall be given by the publication of notice in at least one issue of a newspaper of general circulation within The Metropolitan St. Louis Sewer District not less than ten days in advance of the date of such hearing. 5 The foregoing Resolution was adopted March 19, 1962.
