WHEREAS, by Ordinance No. 699, adopted February 19,
1962, the Board of Trustees of The Metropolitan St. Louis Sewer
District created Subdistrict No. 181 (Bataan & Boswell) and by
Resolution No. 504, adopted March 19, 1962 declared the necessity
of extending the public sewer system by purchasing a private
sanitary sewer system in the area known as Subdistrict No. 181 now
or formerly owned by Town Service, Inc. and provided that the
entire cost thereof shall be paid for by special tax bills or
other evidence of special benefit assessments upon the land within
such subdistrict, and
WHEREAS, adequate notice of a public hearing in respect
to said purchase in said subdistrict was given, and
WHEREAS, a public hearing was held not less than ten
nor more than thirty days after the adoption of Resolution No.
504, to wit: On Monday, April 9, 1962, at Kratz School, 4301
Edmundson Road, St. Louis County, Missouri at which hearing all
persons interested in such purchase were given an opportunity to
be heard,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST LOUIS SEWER DISTRICT that the Board of
Trustees hereby finds and determines that it is in the public
interest that such purchase be made and further determines to
proceed with extension of the public sewer system by such
purchase, to be paid for by special benefit assessments to be
levied ratably by area against all lots or parcels of land in
Subdistrict No. 181 (Bataan & Boswell), whether public or private,
exclusive of public streets, roads and alleys.
The foregoing Resolution was adopted April 23, 1962.
