WHEREAS, there exist within The Metropolitan St. Louis
Sewer District and within the City of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenance,
and which it is desirable for the District to operate and
maintain, and
WHEREAS, the District by Ordinance No. 88, adopted the
16th day of July, 1956, is authorized to assume title to any or
all sewers, easements and appurtenances by resolution whenever, in
the opinion of counsel, no person competent to convey title can be
found, and upon recommendation of the Executive Director that the
District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers and the Executive Director recommends
that the District should assume title to such sewers,
NOW, THEREFORE, BE IT RESOLVED that title to the
following described sewers and their appurtenances in the City of
St. Louis be and are hereby assumed by The Metropolitan St. Louis
Sewer District for public use, operation and maintenance:
1. That sewer constructed under Permit No. 14240 and
lying in Botanical Avenue between Macklind Avenue and Sublette
Avenue.
2. That sewer constructed under Permit No. 14240 and
lying in the east side of Sublette Avenue between Botanical Avenue
and Elizabeth Avenues and lying in Elizabeth Avenue and extending
from Sublette Avenue to Macklind Avenue.
3. That sewer constructed under Permit No. 14240 and
lying in Dempsey Avenue between Sublette Avenue and Macklind
Avenue.
4. That sewer constructed under Permit No. 14240 and
lying in the south side of Bischoff Avenue and extending from
Sublette Avenue to Macklind Avenue.
5. That sewer constructed under Permit No. 14240 and
lying in the west side of Macklind Avenue and extending from
Columbia Avenue to Bischoff Avenue.
6. That sewer constructed under Permit No. 25116 and
lying in the north-south alley in City Block 5888 and lying in
Elizabeth Avenue and extending from Sublette Avenue to January
Avenue.
7. That sewer constructed under Permit No. 25117 and
lying in the easternmost north-south alley in City Block 4048B,
and lying in Dugan Avenue and extending Sublette Avenue to January
Avenue.
8. That sewer constructed under Permit No. 57663 and
lying in the north-south alley in City Block 4047S of the City of
St. Louis.
9. That sewer constructed under Permit No. 60188 and
lying in the east-west alley in City Block 4047N and also in
January Avenue and extending from Bischoff Avenue to said east-
west alley.
The foregoing Resolution was adopted February 7, 1963.
