WHEREAS, a public sewer now in operation lies in an
easement 15 feet wide in property now or formerly of Anthony C.
DiCarlo and Annette Jane DiCarlo, his wife, in U. S. Survey 209,
T47N, A7E, St. Louis County, Missouri, which easement was granted
by instrument dated November 7, 1960, and recorded in Book 4471,
page 483 of the St.Louis County Records, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building in said easement
strip and over said sewer, and examination of the plans and
specifications of such building shows that it would not damage the
existing sewer.
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement strip, provided that
the right of the District to use the easement strip is preserved,
and under suitable indemnity provisions.
The foregoing Resolution was adopted April 5, 1963.
