HomeMy Public PortalAboutR0641 R E S O L U T I O N NO. 641 WHEREAS, the Pollution Abatement Program will require construction by the Mississippi River Subdistrict of an interceptor sewer across the right of way for Highway I-70 at a point between Washington Avenue and Spruce Street, and WHEREAS, the State Highway Commission of Missouri proposes to construct said section of Highway I-70 in the near future, and WHEREAS, the cost of constructing such sewer after completion of said highway would be unnecessarily high and it is in the public interest to provide for simultaneous construction of said sewer and highway under a single contract, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that the Executive Director be and he hereby is authorized and directed to enter into an agreement with the State Highway Commission of Missouri for simultaneous construction of said sewer and highway on substantially the terms of the Agreement annexed hereto as ANNEX TO RESOLUTION NO. 641. BE IT FURTHER RESOLVED that the obligation incurred by such agreement be an encumbrance on existing appropriations from the Subdistrict Planning Fund as reimbursable expenses of the Mississippi River Subdistrict. ROUTE I-70 ST. LOUIS CITY PROJECT I-70-5(64) ANNEX TO RESOLUTION NO. 641 AGREEMENT This agreement entered into this ____ day of ________________, 1963, by and between THE METROPOLITAN ST. LOUIS SEWER DISTRICT, a municipal corporation and a political subdivision of the State of Missouri with its principal office at 2000 Hampton Avenue, St. Louis 10, Missouri, hereinafter called Sewer District, and the STATE OF MISSOURI, acting by and through the STATE HIGHWAY COMMISSION OF MISSOURI, hereinafter called Commission, WITNESSETH: WHEREAS, Commission proposes to construct and improve a section of State Highway designated as Project I-70-5(64), Route I-70, St. Louis City, in the vicinity of Washington Avenue to Spruce Street, in accordance with certain road plans on file in the office of the City Registrar of St. Louis, Missouri, and WHEREAS, as a part of the Pollution Abatement Program, the Sewer District proposes to construct a foul water interceptor trough and 24" interceptor sewer eastward from its existing sewer Shaft No. 4-10C located approximately 65 feet east of Route I-70 centerline at Station 817-19 as generally shown on the plan attached hereto and made a part hereof, and WHEREAS, the simultaneous construction of the foul water sewer would cause conflict with Commission's contractor, and WHEREAS, the construction of the foul water interceptor sewer by the Sewer District after completion of highway construction would necessitate the installation of approximately 40 feet of 24" pipe under the completed pavement and sidewalk, either by trenching or tunnelling, NOW, THEREFORE, it is agreed as follows: 1. That it is more advantageous and economical to the parties that the construction of the foul water interceptor in Shaft No. 4-10C, together with 52 feet of 24" pipe and brick manhole No. M-1 be constructed by Commission in its highway construction contract. 2. That Commission shall include in its highway construction contract the furnishing of all materials, labor and equipment necessary to perform the proposed foul water sewer work shown in red on the attached plan which by reference is incorporated herein and made a part hereof. 3. That Sewer District shall reimburse Commission for material, labor and equipment at the contract bid prices for the actual costs incurred plus 10% for engineering and contingencies. The total cost of the work to be performed by Commission is now estimated to be $4,675.88. Upon the completion by Commission and acceptance by Sewer District of all work covered by this agreement and upon receipt from Commission of two (2) copies of an itemized bill, Sewer District shall promptly make payment in full therefor.
