WHEREAS, a public sewer now in operation lies in an
easement in the North One Half of Section 9, Township 44 North,
Range 6 East, St. Louis County, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer.
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted October 4, 1963.
