WHEREAS, a public sewer now in operation lies in an
easement 15 feet wide in the former east-west alley partly in
Darstdale No. 3 Subdivision and Darstdale No. 3 Amended
Subdivision, between Crixdale Avenue, Coolidge Drive, Olive Street
Road and Grant Drive, of the City of University City, Missouri,
which alley was vacated by Ordinance No. 3660 of said City,
reserving an easement for sewer purposes to this District, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement, and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer,
NOW, THEREFORE BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted January 16, 1964.
