AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN THE 3500
BLOCK OF CHAPEL HILL ROAD; AND AMENDING SECTION 1-17 OF THE CODE
OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY
BOUNDARY BY ADDING ONE NEW SUB -SECTION PERTAINING TO THE SAME
SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, the City Council of the City of
Jefferson desires to annex the unincorporated area of land described in Section 1; and
WHEREAS. the property is adjacent to the current City boundary; and
WHEREAS, a public hearing concerning the annexation was advertised in advance of
the hearing in the Jefferson City News Tribune.
NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The City Council intends to and shall proceed to annex, as provided
by law, the unincorporated area of land described as follows: All of the right of way
known as Chapel Hill Road and part of the right of way known as Bridge Creek Road, as
shown by the plat of Chapel Hill Commons Section Four, a plat of record in Plat Book
12, Page 348, Cole County Recorder's Office, being more particularly described as
follows: Beginning at the Southeasterly Corner of Lot 28 of said Chapel Hill Commons
Section Four; thence northeasterly along the northerly right of way of Chapel Hill Road
the following courses and distances, northeasterly, on a curve to the right, having a
radius of 335.00 feet, an arc length of 138.55 feet (the chord of said curve being
N29039'51 "E, 137.56 feet); thence N41030'45"E, 405.66 feet; thence northeasterly on a
curve to the right, having a radius of 335.00 feet, an arc length of 259.04 feet (the chord
of said curve being N63039'54"E, 252.63 feet); thence N85049'02"E, 42.52 feet to the
southeasterly corner of Lot 30 of said Chapel Hill Commons Section Four; thence
continuing along the right of way of Chapel Hill Road, N85049'02"E, 60.05 feet to a point
on the westerly property line of property described in Book 440, Page 439, Cole County
Recorder's Office, said property boundary also being the boundary of the existing
corporate limits of the City of Jefferson. and said point also being a point on the easterly
right of way of Bridge Creek Road; thence continuing along the right of ways of Chapel
Hill Road and Bridge Creek Road, and the existing corporate limits of the City of
Jefferson, S01 048'00"E. 50.04 feet to a property corner of the said property described in
Book 440, Page 439, said property corner also being the southeasterly corner of said
Chapel Hill Road right of way: thence southwesterly, along the southerly right of way of
Chapel Hill Road and the existing corporate limits of the City of Jefferson the following
courses and distances; S85049'02"W, 58.92 feet. to the most northeasterly corner of Lot
29 of said Chapel Hill Commons Section Four; thence continuing S85049'02"W, 41.57
feet: thence southwesterly on a curve to the left having a radius of 285.00 feet, an arc
length of 220.38 feet (the chord of said curve being S63039'54"W, 214.93 feet); thence
S41030'45"W, 405.66 feet; thence southwesterly on a curve to the left, having a radius
of 285.00 feet, an arc length of 113.37 feet (the chord of said curve being S30007'00"W,
112.62 feet) to a corner point on the boundary of the existing corporate limits of the City
of Jefferson, and said point also being on the southwesterly boundary of said Chapel Hill
Commons Section Four, and the northeasterly right of way of Rock Beacon Road;
thence leaving the said southerly right of way of said Chapel Hill Road, N77019'19"W,
along the existing corporate limits of the City of Jefferson, and along the southwesterly
boundary of said Chapel Hill Commons Section Four, and the northeasterly right of way
of Rock Beacon Road, 50.24 feet to the southeasterly corner of Lot 28 of said Chapel
Hill Commons Section Four, said corner being the beginning point of this description.
Containing 1.00 acre (43,614 square feet, more or less).
Section 2. The City Council finds and declares that the land described in Section
1 is contiguous to the City boundary; that the annexation is reasonable and necessary to
the proper development of the City; and further, did determine the City has an ability to
furnish normal municipal services to this area.
Section 3. A public hearing was held on February 19, 2018 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned RA -2 until such time
as the zoning may be changed in the manner provided for by State Statute and City
Code.
Section 5. Section 1-17 of the City Code of the City of Jefferson, Missouri is
hereby amended by adding one new subsection which shall read as follows:
(AA) The City's boundaries shall also include the following parcel: All of the
right of way known as Chapel Hill Road and part of the right of way known as Bridge
Creek Road, as shown by the plat of Chapel Hill Commons Section Four, a plat of record
in Plat Book 12, Page 348, Cole County Recorder's Office, being more particularly
described as follows: Beginning at the Southeasterly Corner of Lot 28 of said Chapel
Hill Commons Section Four; thence northeasterly along the northerly right of way of
Chapel Hill Road the following courses and distances; northeasterly, on a curve to the

more or less).
Section 6. The annexed area shall be in Ward 3 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area
described in Section 1 will be immediately upon passage, provided that no written
objections to the proposed annexation are filed with the City Council. If sufficient
objections are filed, this ordinance shall not become effective until such time as the
annexation issue has been resolved pursuant to the provisions of Chapter 71 RSMo.

The City Council of the City of Jefferson, Missouri, will hold a public hearing on the following matter on
Monday, February 19, 2018 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal
Building, 320 East McCarty Street, Jefferson City, Missouri.

Case No. P18002-3500 Block of Chapel Hill Rd, Annexation. Petition filed by city staff for the
annexation and zoning of approximately 1 Acre of land consisting of the 3500 block of Chapel Hill
Rd right-of-way. The subject right-of-way is located east of Rock Beacon Rd to the intersection of
Bridge Creek Rd.
A. Voluntary annexation pursuant to Section 71.012 RSMo; and
B. Approval of a zoning plan for the subject property to be zoned RA-2 High Density Residential.
Mr. Zollinger described the proposal and explained that this property consists of 1 acre of land
consisting of the 3500 block of Chapel Hill Rd right-of-way, located adjacent to the existing city
limits. He stated that the property was to be annexed previously as part of the Bridge Creek Road
voluntary annexation Case No. 15002. Mr. Zollinger explained that at that time the city had been in
consultation with the Cole County Public Works Department and the condition of the road was in a
state that it was not favorable for the City to take over. He stated that it was understood that once
Cole County improved the road the City would annex the property. Mr. Zollinger explained that the
road has since been improved and is now ready to be annexed. He stated that the road is adjacent
to City limits and seems proper to be incorporated. Mr. Zollinger explained that based off of the
zoning of the surrounding properties a zoning designation of RA-2 would be appropriate.
No one spoke in opposition to this request and no correspondence was received.
Ms. Cotten moved and Mr. Dutoi seconded to recommend approval of the annexation request
and zoning plan establishing an RA-2 zoning for the property to the City Council. The motion
passed 6-0 with the following votes:

Nature of Request
