WHEREAS, the District is empowered by Plan Section
3.020(6) to sell and convey any property no longer necessary or
useful in its operations, and
WHEREAS, the public interest will be served by the
exercise of this power from time to time as sewage treatment
facilities are constructed and other operational changes occur,
and a procedure is required,
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees
of The Metropolitan St. Louis Sewer District that:
1. The Executive Director shall determine, as the
operations of the District indicate, whether any certain real
property is no longer necessary or useful. He shall thereupon
cause such property to be appraised at its fair market value by at
least two competent, independent and disinterested appraisers.
2. When such appraisal indicates that the value
exceeds the costs of sale, the Executive Director shall invite
proposals for the purchase of the property by giving notice in the
form which follows and on the terms and conditions set forth in
the notice.

NOTICE OF REAL ESTATE TO BE SOLD ON SEALED BIDS
THE METROPOLITAN ST LOUIS SEWER DISTRICT will receive
sealed written proposals at the office of its Executive Director,
2000 Hampton Avenue, St. Louis, Missouri 63139, until the hour of
______ on _____________, the ______ day of ____________, 19____,
for the purchase of all of its interest in and to that certain
real property situated in the City of ____________, County of
___________ State of Missouri, described as follows:

Proposals should be addressed to the undersigned and
must be plainly marked "Proposal for Purchase of Realty."
Proposals will be publicly opened and read at the time stated
above.
The terms and conditions of sale are as follows: Cash
in lawful money of the United States or certified (or cashier's)
check payable to the District, in the amount of three per cent
(3%) of the purchase price to be deposited with each and every
bid; the balance of the purchase price to be paid on or before
delivery of deed. Sale will be made to the highest bidder, subject
to the right to reject any or all bids and subject to confirmation
by ordinance adopted by the Board of Trustees of the District
before the sale becomes binding on the District. Should such
ordinance not be adopted within fifteen (15) days after the
opening of bids, any acceptance of a proposal by the undersigned
shall be void and all bids shall be deemed to have been rejected.

3. The Executive Director shall cause the notice
specified above to be published three times in the St. Louis
Globe-Democrat or the St. Louis Post-Dispatch, newspapers of
general circulation published in the District. The final
publication shall be made at least ten days before the date of
opening of bids.
4. The Executive Director may cause the same notice
to be mailed or sent to all persons having an interest in bidding
for the property.
