WHEREAS, by enactment of Ordinance No. 1002 August 7,
1963, the Board of Trustees established Subdistrict No. 221 (North
Kinloch) of The Metropolitan St. Louis Sewer District within which
sewer facilities may be constructed at the expense of the
subdistrict, and
WHEREAS, the boundaries of such subdistrict include
that part of the City of Kinloch for which adequate sanitary sewer
facilities have not been provided and all of the land in such
subdistrict is capable of being efficiently served by lateral
sewers flowing into existing public trunk sewer facilities, and
WHEREAS, it is the sense of the Board of Trustees that
it is necessary in the interest of the public health of the
District, that sewer improvements be made in the subdistrict
established by Ordinance No. 1002,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
That a system of adequate lateral sanitary sewers in
the area known as Subdistrict No. 221 (North Kinloch) is necessary
in the interest of the public health.
That such sewer system shall consist of approximately
4,560 lineal feet of ten-inch pipe and 57,995 lineal feet of
eight-inch pipe, and the necessary appurtenances, and that such
sewers shall be capable of efficiently serving the entire
subdistrict drainage area.
That the probable cost of such improvement is estimated
to be Seven Hundred Sixty-seven Thousand Dollars ($767,000.00),
based upon preliminary plans prepared for that purpose available
to this Board, and upon the advice of the Executive Director.
That the payment of the entire cost shall conform with
the requirements of Housing and Urban Development Act of 1965 of
the Eighty-ninth Congress, under which the United States is
authorized to make a grant in aid not exceeding 90% of the entire
cost and the remainder must be paid by such subdistrict.
That the part of the cost to be paid by such
subdistrict shall be derived from the sale of general obligation
bonds, payable both principal and interest by and from an annual
tax on all taxable tangible property within such subdistrict,
provided such bonds are authorized by a vote of the registered
voters in Subdistrict No. 221 (North Kinloch) at an election to be
hereafter held for that purpose, in accordance with the Plan of
the District.
BE IT FURTHER RESOLVED that a public hearing be held
within said subdistrict to afford all persons interested in said
improvement an opportunity to be heard; that such hearing shall be
held at such time and place as the Executive Director shall
determine, but not less than ten nor more than thirty days after
the adoption of this Resolution; and that notice of such hearing
shall be given by the publication of notice in at least one issue
of a newspaper of general circulation within The Metropolitan St.
Louis Sewer District not less than ten days in advance of the date
of such hearing. The foregoing Resolution was adopted August 6, 1965.
