WHEREAS, the United States of America has heretofore
made an advance, pursuant to an agreement dated September 13, 1945
to the Affton Sanitary Sewer District in the amount of $2,772.00
for the purpose of plan preparation of the public work described
in the agreement to renovate, remodel and enlarge existing sewage
treatment plant, and
WHEREAS, by the use of the Federal advance the Affton
Sanitary Sewer District caused to be prepared plans and
specifications for the public work described in the aforesaid
agreement, and
WHEREAS, no construction has been undertaken of the
project or any portion thereof described in the aforesaid
agreement dated as of the 1st day of August, 1965, and
WHEREAS, the Affton Sanitary Sewer District has been
dissolved by order of the Circuit Court of St. Louis County,
Missouri, and
WHEREAS, there is no reasonable likelihood of the
planned project, or any portion thereof, being undertaken because
The Metropolitan St. Louis Sewer District has constructed the
Gravois Creek Trunk Sanitary Sewer and this sewer replaced the
entire sewage treatment facilities for the watershed, including
the project facilities, all as certified to by the engineer for
the project,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that as there is no
reasonable likelihood of the project or any portion thereof as
planned with the Federal advance ever being placed under
construction for the reasons set forth above, the Housing and Home
Finance Administrator be requested to make a determination that
the agreement dated on the 13th day of September, 1945 be
terminated and that the Affton Sanitary Sewer District and The
Metropolitan St. Louis Sewer District be relieved of all liability
thereunder.
This resolution is adopted pursuant to the authority
provided by the Plan of The Metropolitan St. Louis Sewer District,
adopted by the voters of St. Louis and St. Louis County, Missouri,
at a special election on February 9, 1954. The foregoing Resolution was adopted August 6, 1965.
