WHEREAS, public sewers now in operation lie in
easements in property now or formerly of Brown Shoe Company, Inc.,
in U.S. Surveys 75 & 76 of Carondelet Common Fields and in Outlot
40 of the City of St. Louis, Missouri, which easements are more
particularly described in instruments granted December 21, 1912
and January 22, 1913, respectively, and recorded respectively in
Book 2644, Page 35 and Book 2644, Page 24, and
WHEREAS, the owners of the land in which such sewers
lie have requested permission to permit the encroachment of a
building across said easements and examination and survey of such
sewers and of such building shows that it will not damage the
existing sewers,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easements, provided that the
right to the District to use the easements is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted November 4, 1965.
