CITY OF TEMPLE CITY

SEPTEMBER 5, 1967
INITIATION:
1. Mayor Beckley called the regular meeting of the City Council
2 to order at 7:30 P. M. Invocation was given by Father Blaire
of St. Luke's Catholic Church, 9451 Broadway, Temple City.
3. Mayor Beckley then led the Pledge of. Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen- Briggs, Harker, Merritt, Tyrell, Beckley
ABSENT: Councilmen -None
ALSO PRESENT: City Manager Koski, City Attorney Martin, Recrea-
tion Director Kobett, Public Works Director Pizzorno
5. APPROVAL OF MINUTES: Regular meeting of August 1, 1967.
Councilman Merritt moved to approve the minutes of the regular
meeting of the City Council of August 1, 1967, Councilman
Tyrell seconded and the motion carried unanimously.
UNFINISHED BUSINESS:
PUBLIC HEARING: 7:30:P. M. RE PROPOSED AMENDMENTS TO THE ZONING CODE
RELATIVE TO LOCATION OF ACCESSORY STRUCTURES ON REAR ONE - THIRD
OF AN INTERIOR LOT
City Attorney Martin advised the Planning Commission have for-
warded a Resolution to the Council recommending an amendment
to the Zoning Code relative to the location of structures
(accessory) on the rear one -third of an interior lot in connec-
tion with rear yard set -back.
Mayor Beckley declared the Public Hearing opened, and asked if
anyone wished to speak in favor or against the proposed amend-
ments. No one came forward to speak. Councilman Merritt moved
to close the Public Hearing, Councilman Briggs seconded, and the
motion carried unanimously.
Following discussion Councilman Merritt moved to instruct the
City Attorney to prepare an Ordinance to conform to the Planning..
Commission recommendations, Councilman Harker seconded, and the
motion carried unanimously.
PUBLIC HEARING: 7:30 P. M. RE EXTENSION OF INTERIM ORDINANCE NO.
67 -232 CONCERNING ACCESSORY STRUCTURES ON REAR 1/3 OF R -1 LOTS
City Attorney Martin explained the present interim ordinance
was expiring and it was necessary to extend the interim ordinance
until the ordinance requested could be prepared and adopted.
Mayor Beckley declared the Public Hearing opened and asked if
anyone wished to speak for or against this interim ordinance.
No one came forward to speak. Councilman Harker moved to close
the Public Hearing, Councilman Briggs seconded, and the motion
carried unanimously.
City Attorney Martin presented for immediate adoption interim
Ordinance No. 67 -246 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TEMPLE CITY EXTENDING INTERIM ORDINANCE NO. 67 -232 which
would be effective until December 1, 1967. Councilman Merritt
moved to waive further reading and to adopt Ordinance No. 67 -246,
Councilman Harker seconded, and the motion was unanimously carried.

PUBLIC HEARING 7:30 P. M. APPEAL FROM PLANNING COMMISSION DECISION:
RUSSELL L. MILLER, 9840 HALLWOOD DR., VARIANCE CASE #67 -225
City Manager Koski presented the appeal from the Planning Commis-
sion decision which denied Variance request of Mr. Miller who
had built a storage area attached to the rear of his garage with-
out a permit and without the 5 ft. side -yard setback requirement.
Mayor Beckley declared the Public Hearing opened. Planning Dir-
ector Dragicevich gave the factual report which showed that the
addition had been constructed to the property side -line, with
an 888 sq. ft. area under roof for storage purposes without a
permit. The illegal construction was referred to the Planning
Commission by the Building Dept. after denying the applicant a
permit because of the non - conformity of the construction. Mr.
Miller then filed for a variance to make his construction legal.
The Planning Commission conducted a public hearing, and found
no special circumstances applicable and due to the lack of the
required 5 ft. setback denied the variance.
Mayor Beckley asked if anyone wished to speak in favor of the
applicant.
Mr. Wm. Dhu Clark, 205 So. Broadway, spoke as attorney for Mr.
Miller and advised there was only one protest and all of the rest
of the neighbors approved and wished to refute the protest.
Mr. Russell, 9840 Hallwood Dr., spoke in favor of the variance
as he considered the construction a great improvement to the
property as well as the neighborhood.
Mr. Miller also spoke in his own behalf, and the following
people in the neighborhood also spoke in favor of the granting
of the variance: Milton Booher, 9807 Hallwood Dr., Lew Bernstein,
9817 Hallwood Dr., Mervyn Cook, 9856 Miloann, John Tierney, 98
32 Key West, David Ackerman, 4840 Agnes ;, Lewis M. Frankel,
4906 N. Agnes': Ave., John Emanuelli, 9842 Key West, Tony Trombelli,

Mayor Beckley asked if anyone wished to speak against this
variance.
Seth A. Carson, 4913 N. Agnes, stated he was the one protestant,
and that the rear of his lot abuts the east side of the Miller
property. He stated the construction did not have the required
5 ft. setback which made it illegal. If granted,a precedent
would be set and anyone could do the same thing. He objected
to the violation of the law.
No one else came forward to speak against the request.
Mr. Miller explained in detail the construction and use of the
storage area for use of his boat and 1 ton pickup truck which
can be driven through the garage to the rear area.
Councilman Briggs moved to close the public hearing, Councilman
Tyrell seconded, and the motion carried unanimously.
Councilman Harker stated all testimony was directed to how well
constructed the addition was and what an improvement, but the
real problem is it is illegal construction without a permit and
without the required sideyard set back.
Councilman Briggs concurred with the statements of Councilman
Harker and agreed with the findings of the Planning Commission.

Councilman Tyrell asked if he moved his roof line back five ft.
from the side lot line if the addition would be satisfactory and
the Planning Director advised it would. Councilman Tyrell stated
the 5 ft. setback is required for fire safety, also that you can
not make something legal when it is illegal, or when it is a safety
hazard.
Councilman Merritt stated the Planning Commission had no com-
plaints against the structure itself only the lack of the 5 ft.
side yard.
Councilman Briggs moved to instruct the City Attorney to prepare
a Resolution denying the appeal from the Planning Commission de-
cision on Variance Case #67 -225, Councilman Harker seconded, and
the motion was unanimously carried.
Councilman Tyrell commented it was aproposs to note the yard of
the complainant did not appear to be in such good shape and it
might be well to have it cleaned up.
ORDINANCE NO. 67 -241: 2nd read. Reclassifying certain property
from C -M to C -2.
City Attorney Martin presented for second reading Ordinance No.
67 -241 AN ORDINANCE OF THE CITY OF TEMPLE CITY RECLASSIFYING
CERTAIN PROPERTY FROM ZONE C -M TO ZONE C -2. Councilman Harker
moved to waive further reading and to adopt Ordinance No. 67-
241, Councilman Merritt seconded, and the motion carried unani-
mously.
7. ORDINANCE NO. 67 -245: 2nd read. Amending Subdivision Ordinance
re Subdivision Fees.
City Attorney Martin presented for second reading Ordinance
No. 67 -245 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING
SECTION 308 OF ORDINANCE NO. 63 -107 RELATING TO SUBDIVISION
FEES. Councilman Merritt moved to waive further reading and
to adopt Ordinance No. 67 -245, Councilman Briggs seconded, and
the motion was carried unanimously.
NEW BUSINESS:
8. RESOLUTION NO. 67 -768: appointing Personnel - Civil Engineering
Assistant.
City Manager Koski presented Resolution No. 67 -768 A RESOLU-
TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING
PERSONNEL. Councilman Briggs moved to adopt Resolution No.
67 -768, Councilman Harker seconded, and the motion carried
unanimously.
9. RESOLUTION NO. 67 -767: appointing Personnel - Park Maintenance
Man.
City Manager Koski presented Resolution No. 67 -767 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING
PERSONNEL. Councilman Harker moved to adopt Resolution No. 67-
767, Councilman Briggs seconded, and the motion carried unanimous -

10. AGREEMENT FOR CANCELLATION OF LEASE: A.& TIMA CUKIER
The City Manager presented the Agreement for Cancellation of
Lease executed by A. & Tima Cukier covering part of the parking
area under lease to the City and which has been purchased as
part of the Ralph's development. He requested authorization
for execution of the release on the part of the City. Councilman
Merritt moved to approve and authorize the Mayor and City Clerk
to sign on behalf of the City, Councilman Harker seconded, and

the motion was unanimously carried.
PARKS & RECREATION COMMISSION RECOMMENDATIONS: Meeting of
August 16, 1967.
A. Recommend renewal of co- sponsorship of Temple City
Chief's La Crosse Club for the coming year.
Recreation Director Kobett presented the above recommendation.
Councilman Merritt moved to approve item A, Councilman Harker
seconded, and the motion carried unanimously.
B. Recommend renewal of co- sponsorship of Temple City
Soccer Club for the coming year.
Recreation Director Kobett presented the above recommendation..
Councilman Harker moved to approve item B, Councilman Briggs
seconded, and the motion carried unanimously.
12.. SISTER CITY REPORT:
President Don Wienke reported on the recent trip to Magdalena .
and the presentation of the woodworking equipment to them..
Mr. Geo, Koumachian, Vice - Pres., together with Mr. Wienke pre-
sented the program as planned for the future which included
instruction on the woodworking equipment, student exchange,
cultural and art exchange, and possibly having the Magdalena
queen ride on one of the floats at the Camellia Festival.
13. PARKING COMMISSION RECOMMENDATIONS: Regular Meeting of Aug. 9
and Special Meeting of Aug. 30, 1967.
A. Item 6. (Aug. 9) Review of Parking Commission Ordinance
No. 65 -119, Section 7301, recommend amendment to read as
follows: "The Commission shall consist of five members
each of whom shall be a property owner or in business in
one of the Parking Districts of the City of Temple City."
The Public Works Director presented the above recommendation.
Following discussion Councilman Tyrell moved to approve re-
commendation A striking "or in business" from it, Councilman
Merritt seconded, and the motion carried unanimously.
B. Item 2. (Aug. 30) Recommend "Enter" and "Exit" signs be
placed at the entrance and exit of Parking Lots 2, 3 and 7;
and that "Do Not Enter" signs be placed at the exit of
Lots 1, 5 and 6.
The Public Works Director presented the above recommendation.
The Traffic Engineer explained they were making an evaluation
of the traffic flow in the parking lots and the primary con-
cern is the double lots. Following discussion it was felt
the signs should be tried and that they should be placed on
the apron. Councilman Tyrell so moved, Councilman Harker
seconded, and the motion carried unanimously.
C. Item 3. (Aug. 30) Dedication of Parking District Lots.
Recommend the Chamber of Commerce be permitted to use the
Parking District Lots for the Mall Dedication ceremonies
and the placement of Kiddie Rides, an Antique Car Show and
Art Exhibit, subject to insurance requirements of the City.
The Public Works Director presented the above recommendation
and following discussion Councilman Merritt moved to approve,
Councilman Briggs seconded, and the motion carried unanimously.
Councilman Tyrell also recommended that Bill Woollett, former
City Manager, be issued a special invitation for the dedication
and lunch as the malls were his original idea.

14. TRAFFIC COMMISSION RECOMMENDATIONS: Regular meeting of Aug. 2,.
1967.
A. Item 7. North -south one -way alley south of Las Tunas be-
tween Cloverly and Primrose, recommend placement of stop
signs and stop bar pavement markings at Workman and the
south end of the alley between Cloverly and Primrose; and
at Woodruff and the north end of the alley between Camellia
and Kauffman.
Traffic Engineer Envall presented and explained the above re-
commendation. Councilman Tyrell moved to approve "A ", Coun-
cilman Briggs seconded, and the motion carried unanimously.
B. Item 10. Lower Azusa Rd., Temple City Blvd. to Ellis Lane:
Recommend double centerline striping and a north lane line
be placed on Lower Azusa Rd. from Temple City Blvd. to a
point approximately .25 of a mile easterly, and red curb
markings be placed on the north side of Lower Azusa Rd.
from a point 56 ft. to 126 ft. east of Temple City Blvd.,
a distance of 70 ft.
The Traffic Engineer presented and explained the above recom-
mendation. Councilman Briggs moved to approve "B" as recommend-
ed, Councilman Harker seconded, and the motion carried unanimous-

C. Item 11. Temple City Blvd. east side of Las Tunas Dr. Re-
commend 35 ft. "Mail Box Use Only" zone be placed on east
side of Temple City Blvd., south of Las Tunas, from fire
hydrant southerly to north drive of offstreet parking facili-
ties to accommodate the snorkel type mail box.
Traffic Engineer Envall presented the above recommendation. Coun-
cilman Briggs moved to approve item "C ", Councilman Merritt se-
conded, and the motion carried unanimously.
D. Item 12. Encinita & La Rosa Dr. Recommend red curb markings
on west side of Encinita Ave. from a point 35 ft. north of
north curb line of La Rosa Dr. to a point 54 ft. northerly
thereof and on east side from south line of bridge to first
driveway southerly, a distance of 60 ft.
The Traffic Engineer presented and explained the above recommenda-
tion. Councilman Briggs moved to approve item "D ", Councilman
Merritt seconded, and the motion was unanimously carried.
E. Item 1. Temple City High School & Surrounding Area -
Traffic & Allied Problems.
a. Recommend "Memorandum of Information" concerning exist-
ing traffic and allied problems in areas adjacent to
Temple City High School, with which the Commission does
concur, be presented to the City Council for considera-
tion and action.
b. Recommend "No Parking Between 7 A. M. and 5 P. M..
School Days Only" be placed on south side of Lemon
between Oak and Trelawney.
The Traffic Engineer presented the above recommendations.
Considerable discussion followed concerning part "a ". Council-
man Tyrell moved to forward the "Memorandum of Information" to
the school board for some action, Councilman Merritt seconded,
and the motion carried unanimously.
Traffic Engineer Envall presented recommendation "b ". Council-
man Merritt moved to approve item "b" Councilman Briggs second-
ed and the motion was unanimously carried.
15. AGREEMENT: Tram Agreement for Mall Dedication Ceremonies with
Venice Tram Co. for Sept. 21, 22, and 23.
The City Manager presented the above Agreement. Councilman
Harker moved to approve and authorize the Mayor and City Clerk
to sign on behalf of the City, Councilman Briggs seconded, and
the motion carried unanimously.

16.. MINUTE ORDER: Re State Housing Dept.
`city Attorney Martin advised it is customary to inform the
State Housing Dept. that Temple City has building codes equal
stronger than the State requirements and will enforce it's
own regulations, which he recommended the Council do by adop-
tion of a minute order. Councilman Briggs so moved, Councilman
Tyrell seconded, and the motion carried unanimously.
17. SET PUBLIC HEARING: APPEAL FROM DECISION OF PLANNING COMMIS-
SION: ZONE VARIANCE CASE #67 -230 Robt. & Elsie M. Kukurin.
The City Manager presented the above appeal. Councilman
Tyrell moved to set the appeal for public hearing on Sept.
19, 1967, at 7:30 P..M., Councilman Merritt seconded, and the
motion carried unanimously. Also the letter received after the
appeal was filed re clarification of the zoning code -as to :a coin
operated car wash.should7be 'referred back to the P1 :alining :...Commis-
sion for consideration at their meeting of Sept. 12 with.a re-
commendation forthcoming to the Council from that meeting.
18. RESOLUTION NO. 67 -769: Warrants & Demands.
City Manager Koski presented Resolution No. 67 -769 A RESOLU-
TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING
CLAIMS AND DEMANDS IN THE SUM OF $105,873.45, DEMAND NOS. 9965
THROUGH 10067. Councilman Briggs moved to adopt Resolution
No. 67 -769, Councilman Harker seconded, and the motion carried
unanimously.
19. COMMUNICATIONS:
A. Request for Charitable Solicitation Permit by National
Cystic Fibrosis Research Foundation From Sept. 1 -15.
The City Manager presented the above request. Councilman
Tyrell moved to grant, Councilman Briggs seconded, and the
motion carried unanimously.
B. Request for Charitable Solicitation Permit by Santa Anita
Girl Scout Council, Nov. 17 - Deco 11, for a calendar sale.
The City Manager presented the above request. Councilman
Tyrell moved to grant, Councilman Briggs seconded, and the
motion was unanimously carried.
C. Request by D. A. R. Alhambra -San Gabriel Chapter that
Sept. 17 -23 be proclaimed "Constitution Week" and Sept.
17 be proclaimed as "Citizenship Day ".
City Manager Koski presented the above request. Councilman
Tyrell moved to so proclaim, Councilman Merritt seconded, and
the motion carried unanimously.
D. Request for charitable solicitation permit from the Temple
City Lions Club for White Cane Days on Sept. 29 and 30.
The City Manager presented the above request. Councilman
Harker moved to grant, Councilman Harker seconded, and the
motion was unanimously carried.
E. Request for proclamation from Federation of Labor AFL /CIO
to proclaim Labor -Day Week as "Union Label Week ",
City Manager Koski presented the above request for a proclamation.
Following discussion Councilman Harker moved to so proclaim,
Councilman Merritt seconded, roll call vote to carry the motion
as follows:

NOES: Councilman- B`r•iggs
ABSENT: Councilmen -None

20. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came
forward to speak at this time.

21. MATTERS FROM CITY OFFICIALS:
City Manager Koski presented a letter from the Camellia Festival
Committee asking support from the City for the 24th Camellia
Festival to be held in February of 1968, for use of the Live
Oak Park bleachers for parade viewing, use of light standards for
camellia banners and the permit to hang them, street parking
ban on a temporary basis, a parade permit, and permission to
paint a blue line at the street center for the day of the parade,
Febr. 24, 1968. Councilman Merritt moved to approve subject to
insurance requirements, Councilman Harker seconded, and the
motion carried unanimously.
The City Manager also presented a letter from the Chamber of
Commerce re the condition of the alleys in the downtown area.
He advised the staff will be working with the Chamber on this
program.
City Manager Koski presented a request from the Sister City
Committee for the use of the Council Chambers the evening of
Sept. 21, which was approved.
The City Manager advised the petition heading concerning the
War in Viet Nam had been revised in accordance with Council
suggestions and was ready for disposition.
22. ADJOURNMENT: Councilman Briggs moved to adjourn to a study
session with the Board of Education and to reconvene at the
end of that time, Councilman Merritt seconded, and the motion
carried unanimously. The Council adjourned to the study
session at 9:55 P. M. in the North Meeting Room.
The Council re- convened at approximately 10:45 P. M. following
the presentation of the program "The Citizen and the Law ".
Councilman Merritt moved to concur in the content of the course
as presented in the booklet entitled "The Citizen and the Law"
prepared by the Temple City Unified School District in August,
1967, Councilman Harker seconded, and the motion carried unani-
mously.
Council adjourned at 10:55 P. M. to the next regular meeting of
the City Council on Sept.19, 1967, at 7:30 P. M. in the Council
Chambers of the City Hall.
