HomeMy Public PortalAboutR0838 R E S O L U T I O N NO. 838 WHEREAS, pursuant to dissolution of the Webster Groves Sanitary Sewer District, and of a contract incident thereto, approved by decree of the Circuit Court of St. Louis County in the matter of Webster Groves Sanitary Sewer District, Cause No. 114,479, The Metropolitan St. Louis Sewer District is owner of all unpaid taxes and assessments of Subdistricts Nos. 14, 15, 16 and 17 of said former sanitary sewer district, and WHEREAS, special benefit assessments for rental charges of said subdistricts were imposed under Section 249.400, were collectible by St. Louis County under Section 249.410.1 of the Revised Statutes of Missouri, and are outstanding and unpaid, as follows: Year Subdistrict No. Amount Due 14 $ 646.70 1957 15 1,079.97 1957 16 886.51 1956 17 660.58 1953 and WHEREAS, the lien of said assessments can not be enforced against the assessed lands under applicable law because suit for foreclosure was not brought within five years after payment became delinquent, as required by Sections 140.160, 141.340 or 516.120 of the Revised Statutes of Missouri, and WHEREAS, the Department of Revenue of St. Louis County has expressed the opinion that said assessments are uncollectible, and 2 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that the District renounces its contractual rights to receive payments of said assessments and waives any claim which it may have against St. Louis County with respect thereto. The foregoing Resolution was adopted December 29, 1965.
