HomeMy Public PortalAboutR0876 R E S O L U T I O N NO. 876 WHEREAS, The Metropolitan St. Louis Sewer District has applied to the Department of Housing and Urban Development, United States of America, for a grant under P. L. 89-117, to aid in financing the construction of 4,560 feet of 10" pipe and 57,995 feet of 8" pipe, and 2,260 lineal feet of manhole construction and appurtenances serving 3,065 parcels of ground, including 1,125 homes in Kinloch, St. Louis County, Missouri, and WHEREAS, the Department of Housing and Urban Development, United States Government, has requested a policy statement regarding the land or easement acquisition for this project, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: The Metropolitan St. Louis Sewer District, hereinafter referred to as "Applicant", hereby states that its policy for the acquisition of land or easements for the construction of all sewers in Project No. WS-5-26-0015 will be as follows: 1. The applicant will make every reasonable effort to acquire the real property by a negotiated purchase before instituting eminent domain procedures. 2. The applicant will not require any owner to surrender possession of real property until the applicant pays or causes to be paid to the owner: (a) the agreed purchase price arrived at by negotiation, or (b) in any case where only the amount of the payment to the owner is in dispute, no less than 75% of the appraised fair value as approved by the applicant and concurred in by the Department of Housing and Urban Development. 3. The applicant will not require any person lawfully occupying property to surrender possession without at lease ninety days written notice from the applicant of the date on which possession will be required. The foregoing Resolution was adopted May 9, 1966.
