WHEREAS, a public sewer now in operation lies in an
easement granted this District by the Intermountain Terminal
Company by instrument dated July 6, 1964, and recorded in Book
8530, Page 346 of the City of St. Louis Records, which easement
lies in City Block 4218 of the City of St. Louis, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
without basement across said easement and examination and survey
of such sewer and of such building shows that it will not damage
the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right to the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted June 21, 1966.
