WHEREAS, the City of St. Louis, Missouri, by Ordinance
No. 52770, approved July 1, 1964, vacated, among others, that
portion of Rutger Street between Broadway and Seventh Boulevard,
and
WHEREAS, a public sewer now in operation lies in such
portion of vacated Rutger Street, which portion is now the
property of the State Highway Commission of Missouri, but, through
inadvertence no easement for sewer purposes was specifically
retained for this District by such Ordinance, although it exists
by operation of law,
NOW, THEREFORE, BE IT RESOLVED that an easement for
sewer purposes over the area of that portion of Rutger Street
between Broadway and Seventh Boulevard should have been
specifically retained by aforesaid ordinance, but was retained by
this District by operation of law, and it is hereby declared that
The Metropolitan St. Louis Sewer District owns an easement for
sewer purposes in that area of former Rutger Street lying between
Broadway and Seventh Boulevard in the City of St. Louis, Missouri.
The foregoing Resolution was adopted December 22, 1966.
