WHEREAS, a public sewer now in operation lies in an
easement in former John Avenue, between McKissock Avenue and the
northward extension of the west line of the alley in City Block
1938, which easement was reserved to this District by Ordinance
52822 of the City of St. Louis, approved October 22, 1964, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement provided that the
right to the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted January 5, 1967.
