WHEREAS, a public sewer now in operation lies in a
easement granted by the Board of American Missions of the United
Presbyterian Church of North America, by instrument dated April
30, 1957 and recorded in Book 3767, Page 504 of the St. Louis
County Records and which easement lies in part of Lot 1, Sturdy
Subdivision, and in part of Lot 2, Eddie Estate Subdivision in
Partition, in St. Louis County, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right to the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted July 6, 1967.
