HomeMy Public PortalAboutR0950 R E S O L U T I O N NO. 950 RESOLUTION authorizing filing of application with the Department of Housing and Urban Development, United States of America, for a grant under Title VII of the Housing Act of 1961, as amended. WHEREAS Title VII of the Housing Act of 1961, as amended, provides for the making of grants by the Secretary of Housing and Urban Development to States and local public bodies to assist them in the acquisition and development of permanent interests in land for open-space uses where such assistance is needed for carrying out a unified or officially coordinated program for the provision and development of open-space land as part of the comprehensively planned development of the urban area; and WHEREAS, The Metropolitan St. Louis Sewer District (herein sometimes referred to as "Applicant") desires to acquire title to certain land known as: A tract of land situated partly in the southeast one-fourth of Fractional Section 18, and partly in U.S. Survey 210, both in Township 47 North, Range 7 East, St. Louis County, Missouri; approximately 3,000 feet east of Old Halls Ferry Road, and adjacent to the south side of the Coldwater Creek; consisting of approximately 32 acres of undeveloped land in its natural state, that is, uneven topography containing several trees of Walnut, White Ash, Hard Maple, Sycamore and Black Oak, of heights up to 50 feet and of diameters up to 4 feet, all of which enhance the overall natural beauty of said land, which land is to be held and used for permanent open-space land for passive type recreation and preservation of the natural state of the tract, (legal description attached hereto). TRACT OF LAND TO BE ACQUIRED FROM JOHN F. HOENE AND AGNES HOENE, HIS WIFE IN TOWNSHIP 47N, RANGE 7E, ST. LOUIS COUNTY, MISSOURI A tract of land situated partly in the southeast 1/4 of Fractional Section 18, and partly in U.S. Survey 210, both in Township 47 North, Range 7 East, St. Louis County, Missouri, and together described as: Beginning at the southwest corner of the 40.10 acre tract of land conveyed to John F. Hoene and wife by deed recorded in Book 2080, Page 51, St. Louis County Recorder's office, being at the southwest corner of the southeast fractional 1/4 of said Section 18; thence along the south line of said Hoene Tract, being along the south line of said Section 18, south 89Ε 17' East, 928.80'; thence North 27Ε 39' East, 226.25'; thence North 06Ε 13-1/2' West, 332.22'; thence North 75Ε 44-1/2' East, 274.99'; thence North 81Ε 44-3/4' East, 560.03'; thence North 76Ε 45' East, 314.98'; thence North 67Ε 22' East, 610.47' to an intersection with the east line of said Fractional Section 18; thence along said east line of Fractional Section 18, North 00Ε 43' East, 220', more 3 or less, to its intersection with the centerline of the Coldwater Creek (formerly Drainage District No. 2A) right-of-way, 100' wide; thence southwestwardly and westwardly along said right-of-way centerline, being on a curve with a curve with a radius of 1,909.86' to the right, 1,355', more or less, to the southeast corner of a tract of land conveyed to The Metropolitan St. Louis Sewer District by deed recorded in Book 5184, Page 607, said Recorder's office; thence westwardly along the southern line of said Sewer District property the following courses and distances (which are unrelated to the foregoing courses shown herein): North 89Ε 27' West, 86.86'; North 35Ε 35' West, 43.34'; North 35Ε 45' West, 97.68'; North 73Ε 12' West, 108.82'; South 73Ε 03' West, 68.90'; South 17Ε 26' West, 89.04'; South 15Ε 31' West, 36.08'; and North 88Ε 31' West, 823.36' to the southwest corner of said Sewer District property; thence westwardly along the centerline of said Coldwater Creek right-of-way, 234', more or less, to its intersection with the west line of the southeast 1/4 of said Fractional Section 18; thence southwardly along said west line of the southeast 1/4 of Fractional Section 18, 817', more or less, to the beginning. WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and Urban Development effectuating that Title, provide that no person shall be 4 discriminated against because of race, color, or national origin in the use of the land acquired and/or developed; and WHEREAS, it is recognized that the contract for Federal grant will impose certain obligations and responsibilities upon the Applicant and will require among other things (1) assurances that families and individuals displaced as a result of the open- space land project are offered decent, safe, and sanitary housing, (2) compliance with Federal labor standards, and (3) compliance with Federal requirements relating to equal employment opportunity; and WHEREAS, it is estimated that the cost of acquiring said interest(s) will be One Hundred Twenty Thousand ($120,000.00) Dollars; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: 1. That an application be made to the Department of Housing and Urban Development for a grant in an amount authorized by Title VII of the Housing Act of 1961, as amended, which amount is presently estimated to be Sixty Thousand ($60,000.00) Dollars, and that the Applicant will pay the balance of the cost from other funds available to it. 2. That the Executive Director is hereby authorized and directed to execute and to file such application with the Department of Housing and Urban Development, to provide additional information and to furnish such documents as may be required by said Department, to execute such contracts as are required by said 5 Department, and to act as the authorized correspondent of the Applicant. 3. That the proposed acquisition is in accordance with plans for the allocation of land for open-space uses, and that, should said grant be made, the Applicant will acquire, and retain said land for the use(s) designated in said application and approved by the Department of Housing and Urban Development. 4. That the United States of America and the Secretary of Housing and Urban Development be, and they hereby are, assured of full compliance by the Applicant with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964. 6 The foregoing Resolution was adopted June 22, 1967.
