WHEREAS, a former North-South alley 15 feet wide,
situated about 125 feet East of Kingshighway in City Block 5264 of
the City of St. Louis, Missouri, was vacated by City Ordinance No.
52083 with reservation of a sewer easement therein for The
Metropolitan St. Louis Sewer District; and
WHEREAS, an operating brick sewer of the District was
then and is now situated in such easement strip at a depth of
about 28 feet; and
WHEREAS, the owner of the land burdened by such
easement has requested permission to construct a building to
extend across the North 160 feet of such 15 foot wide easement
strip; and the Board is informed that the proposed building will
not damage said sewer;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that the Executive
Director be and he is hereby directed to license the aforesaid
encroachment on the North 160 feet of said easement strip,
provided the right of the District to use its easement is
preserved, and under suitable indemnity provisions.
The foregoing Resolution was adopted June 27, 1968.
