WHEREAS, a public sewer now in operation lies in a
former east-west alley 15 feet wide in City Block 970 of the City
of St. Louis, Missouri, bounded by Jefferson Avenue and Dayton,
Elliott and Gamble Streets; and
WHEREAS, the City of St. Louis, by Ordinance No. 55147,
approved July 11, 1968, vacated such alley, reserving, however, an
easement therein for sewer purposes to this District; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right to the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted October 24, 1968.
