WHEREAS, a public sewer now in operation lies in an
east-west easement ten (10) feet wide, granted by instrument
recorded in Book 6235, Page 1045 of the St. Louis County Records,
and lying in parts of Lot A of Diem's Subdivision of Lot 4 of
Orth's Subdivision, and Lot 1 of Luella Place, subdivisions of St.
Louis County, Missouri according to the plats thereof recorded
respectively in Plat Book 1, Page 110 and Plat Book 20, Page 98 of
the St. Louis County Records, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said easement and examination and survey of such sewer and
of such building shows that it will not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right to the Distract to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted January 8, 1969.
