HomeMy Public PortalAboutR1030 R E S O L U T I O N NO. 1030 WHEREAS, The Metropolitan St. Louis Sewer District has applied to the Department of Housing and Urban Development, United States of America, for a grant under Title VII of the Housing Act of 1961 as amended by the Housing and Urban Development Act of 1965, to aid in financing the construction of trunk and lateral sanitary sewers in Subdistrict No. 264 (Robertson), and WHEREAS, the Department of Housing and Urban Development, United States Government, has requested a policy statement regarding this land acquisition, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: The Metropolitan St. Louis Sewer District, hereinafter referred to as "Applicant," hereby states as follows its policy for the acquisition of said land. Applicant will: 1. Make every reasonable effort to acquire each property by negotiated purchase before instituting eminent domain proceedings against the property. 2. Not require any owner to surrender the right to possession of his property until the public body pays, or causes to be paid, to the owner (a) the agreed purchase price arrived at by negotiation, or (b) in any case where only the amount of the payment to the owner is in dispute, not less than 75 percent of the appraised fair value as approved by the public body and concurred in by HHFA. 3. Not require any person lawfully occupying property to surrender possession without at least 90 days' written notice from the public body of the date on which possession will be required. The foregoing Resolution was adopted January 23, 1969.
