HomeMy Public PortalAboutR1031 R E S O L U T I O N NO. 1031 WHEREAS, the Trustees of Northland Hills Nos. 4, 5 and 6 Subdivisions, have signed quit-claim deeds purportedly dedicating "sewers, drainage right-of-way, and sewage treatment facilities" to the City of Dellwood, The Metropolitan St. Louis Sewer District, and St. Louis County and have recited therein that the donees have promised "to provide for the repairs, reconstruction, maintenance and operation of the sewers, sewage treatment facilities and drainage right-of-way given by the said parties of the second part," and WHEREAS, The Metropolitan St. Louis Sewer District is in complete sympathy with the problems posed by the storm water ditch through such subdivisions and has held numerous meetings with the residents and their representatives with a view to solving the problem, and WHEREAS, the District's Charter required that construction of sewer and drainage structures be done primarily at the cost of those benefitted thereby, NOW, THEREFORE, BE IT RESOLVED that The Metropolitan St. Louis Sewer District must refuse the tender of the additional storm water ditches and other facilities contained in their purported dedication to the District by the aforesaid quit-claim deeds dated December 4, 1968 and signed by the Trustees of Northland Hills Nos. 4, 5 and 6 Subdivisions and the Executive Director is hereby directed to return same to the grantors thereof or their attorney. The foregoing Resolution was adopted January 23, 1969.
