WHEREAS, a public sewer now in operation lies in an
easement ten (10) feet wide in Part of Lots 11 and 12 of James R.
Bissell's Estate, U.S. Survey 2448, Township 46 North, Range 7
East, St. Louis County, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a retaining
wall across said easement and examination and survey of such sewer
and of such structure show that it will not damage the existing
sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right to the District to use the easement is preserved, and under
suitable indemnity provisions.
The foregoing Resolution was adopted February 6, 1969.
