HomeMy Public PortalAboutR1060 R E S O L U T I O N NO. 1060 WHEREAS, there exist within The Metropolitan St. Louis Sewer District and within the County of St. Louis certain sewers hereinafter described which are in such condition as to be acceptable to the District for public operation and maintenance, and which it is desirable for the District to operate and maintain, and WHEREAS, the District by Ordinance No. 88, adopted the 16th day of July, 1956, is authorized to assume title to any or all sewers, easements and appurtenances by resolution whenever, in the opinion of counsel, no person competent to convey title can be found, and upon recommendation of the Executive Director that the District should assume title to such sewers, and WHEREAS, the General Counsel has given his opinion that no person can be found who is competent to convey title to the hereinafter described sewers and the Executive Director recommends that the District should assume title to such sewers, in that they form an integral part of the sewer system serving the public. NOW, THEREFORE, BE IT RESOLVED that title to the following described easements, sewers and their appurtenances in the County of St. Louis be and are hereby assumed by The Metropolitan St. Louis Sewer District for public use, operation and maintenance as an integral part of the public sewer system: 1. Those sewers, both sanitary and stormwater, and their appurtenances, lying in the street and easements of Sturdy Estates Plat 1, Sturdy Estates Plat 2 and Sturdy Estates Plat 3, subdivisions of St. Louis County, Mo., according to the plats thereof recorded, respectively, in Plat Book 71, Page 9, Plat Book 75, Page 14 and Plat Book 79, Page 17 of the St. Louis County Records. 2. That sewer lying in property now or formerly of Mary Alice Berndt and Joseph P. Berndt, her husband, in an easement granted to this District by instrument recorded in Book 3691, Page 499 of the St. Louis County Records. 3. An easement for sewer purposes over a strip of ground 1 foot wide and 420.02 feet in length reserved by the plat of Rolling Hills, a subdivision of St. Louis County, Mo., according to the plat thereof recorded in Plat Book 65, Page 35 of the St. Louis County Records, such easement strip being further described as the western 1 foot of said subdivision, extending from the northwest corner of Lot 14 thereof northwardly to the southwest corner of Lot 35 thereof. The foregoing Resolution was adopted May 28, 1969.
