WHEREAS, a public storm water sewer now in operation
lies in easements in the Western five feet of Lot 6 and the
Eastern five feet of Lot 7 of Brentwood Industrial Court, a
subdivision of St. Louis County, Missouri, according to the plat
thereof recorded in Book 113, Page 62 of the St. Louis County
Records, and
WHEREAS, the owners of the land in which such sewer
lies have requested permission to encroach with a building across
said easements and survey of the sewer and the building show that
such encroachment will not damage the sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easements, provided that the
present right of the District to use the easements is preserved
and the District is indemnified against liability, loss, or damage
from such encroachment.
The foregoing Resolution was adopted August 15, 1969.
